I already know both my Senator and Assembly person would not support this Bill. I sent them my "fuck this shit" comments anyway.

The state is not doomed. NRA, etc. turned 2A into a partisan GOP issue. They have no relationship with Dems by their own choice. We need to develop one. It will not be easy but it is doable.

The bill...for those that didn't read it.
If a gun is not in your immediate possession and you live in a house with a person under 16 or prohibited person the gun must be locked up.
Nothing real shocking there as most of us probably do this anyways.
-you can still sleep with your gun under your pillow
-you don't have to store it unloaded or ammo in a separate location.
-if you don't have kids you can leave your loaded gun anywhere in your house while you are away.
Okay, even if this passes, how the hell would these retards know if I store my guns their "Safe way"?

I did read the the bill and that is not exactly what it says.
"RESPONSIBLE FIREARM STORAGE IS THE LAW IN NEW YORK STATE. FIREARMS MUST EITHER BE STORED WITH A GUN LOCKING DEVICE OR IN A SAFE STORAGE DEPOSITORY NOT BE LEFT OUTSIDE THE IMMEDIATE POSSESSION AND CONTROL OF THE OWNER OR OTHER LAWFUL POSSESSOR. FIREARMS SHOULD BE STORED UNLOADED AND LOCKED IN A LOCATION SEPARATE FROM AMMUNITION. LEAVING FIREARMS ACCESSIBLE TO A CHILD OR OTHER PERSON MAY SUBJECT YOU TO IMPRISONMENT, FINE, OR BOTH."
The assholes who drafted this (and the previous law) set a trap when using the word "should". "In statutes the word "should" must be read in context to determine if it means an act is optional or mandatory, for it may be an imperative. Non-lawyers tend to see the word "may" or "should" and think they have a choice or are excused from complying with some statutory provision or regulation. "
With this bill (as well as previous), a gun owner who did not unload a gun in storage or did not store the ammunition could be in potentially more severe civil jeopardy, following a consequential event, because of this bill. Similarly the basis in this bill could be used when criminally presenting some case for negligence.

Yeah, I understand, but neither section was actually covering the penal element. One was from an early basis section and the other from the new mandatory retail posting.
To simplify my points ...
1 - ( a NY gun owner- either securing a loaded gun or - storing ammunition with a secured gun is NOT exempt from either civil or criminal liabity because a "should" statement is used in a bill's basis)
2 - ( "should" is not neccessarily a "recommendation" in penal law)
... I edited the post to only leave the mandatory posting from the proposed new legislation.
Bottom line, a gun owner in NY, with or without this changed legislation, is taking some additional risk if a gun is stored but loaded, or if ammunition is kept with a gun. We live in a litigious society and discussing "ammo storage" or "if a gun was loaded" in the mandatory posting can increase jeopardy.

Yes...That's todays answer...correct...backup 60 years ago and the answer was...the property in my house is mine and keep your hands off unless invited to touch and if your kids are here, keep an eye on them so they keep their hands off also. That's how it was.

I still think that giving a gun to your own child, who is between the ages of 12 and 16, would be a violation of this law. It would be out of your immediate possession. Or does that make the kid the "custodian?" If they don't become the "custodian," it seems to me that this increases the age at which kids can use guns to 16. What happens if the kid forgets to lock it up (or can't because they don't know the safe combo)? Do they get charged for violating the law that is supposed to protect them?
