Monroe County Parks laws / Carrying Concealed

So out of curiosity, because all counties vary, I revisited laws and regulations for weapons in monroe county again. I couldn't find anything with a few quick searches for surrounding counties other than wayne county, which is roughly similar to what carrying in a NYS park would be like. Comes down to Violations, punishable by fines, and some listing potentially jail time? (maybe someone can chime in on that). Well, I just found out that Monroe county NY punishes the offense of carrying concealed in a county park by a misdemeanor! Are you kidding me?

Monroe County, NY: Weapons.

§ 323-28Weapons.
A.
No person except a law enforcement officer shall carry any firearm, switchblade, gravity knife, slingshot or other dangerous weapon concealed on or about his or her person while in a park.

B.
No person except a law enforcement officer shall carry, fire or discharge any rifle, shotgun, machinegun, rocket or fireworks of any description, bow or arrow in a park.

C.
These prohibitions do not apply to instrumentalities reasonably necessary for trapping utilized by persons authorized to trap in a park pursuant to § 323-18B above.

D.
Nonobservance of this section shall constitute a misdemeanor.


So, considering there are so many hiking trails in monroe county with a pretty large population even in the suburbs, this is kind of shitty. What are your thoughts for locals other than concealed is concealed, even though concealed is concealed.

How is any reasonable person suppose to know where all these areas that suspend the constitution are? From what I understand, in Albany, there are certain streets that are constitutionally exempt from second amendment protection. They take some much of my money I have little left to fight them. They shoot me with my own ammo.

I often drive through Mendon Ponds Park, etc.on public roads and according to Mo Co sheriff, I'm breaking the law if I'm carrying concealed.
Hell, you can't even trail ride a bike in the parks but horses are ok. The county park system is great but totally fucked up.

There was a push to get this law changed a few years back. Then SAFE happened and it fell on the back burner. A bunch of us went to the county legislature meeting and spoke about it. I wrote a op-ed piece that got published in the D&C as well.

Can they write a law to be harsher then State? Or did the safe act BS back them up?

They can write all the laws they want and they won't be overturned until someone challenges them.

I have a question I'm hoping anyone can clarify. I'm assuming this is for just monroe COUNTY parks (as listed monroe county park signs) and NOT every other park or trail system inside of monroe county? Since the park maps list just a handful of trails, there are way more hiking trails that aren't listed including walk paths, and canal system that flows through, etc.

This is the listed - all Monroe county parks map below. I wouldn't rely on just this, because maybe they missed one or something, but would I be correct in assuming this, in which case we would be good to carry in every other park?

I might be mistaken, but I have yet to see metal detectors at any of the county parks or canal trails or the Genesee Riverway trail or really anywhere else in Monroe County except the secure zone of the ROC airport and the Hall of Justice. Keep calm and carry on.....

I go everywhere with my protection and most definitely in a secluded hiking area. Pretty much all I ever do with my spare time is hike,fish,metal detect,quad in many many many of the Hudson valley counties since 1990ish and right up til yesterday even (and have had my permit since 1994)..the times I got in trouble 0, the times I encountered a DEP/DEC in any of the locations 0. These "laws" mean nothing! If you're concealed and bump into a state officer of any version while doing any of the above mentioned recreations, it's not like your gonna get airport strip body searched. Carry on, and protect yourself and loved ones..deal with the repercussions after you survive...

Yeah, I spend most of my time outside backpacking. The problem with this, is it is a misdemeanor and not a violation and just a fine, or you're asked to leave from a business etc. If you're stopped for any reason there is a much, much bigger price to pay. Shit does happen, Maybe you get pulled over for a tail light out after coming out of the park and an officer asks if you're carrying when he/she is alerted you're a permit holder? What happens after they're aware you're a permit holder even when you don't mention anything? When they drop the question if you're currently concealing etc. Definitely will get your permit revoked for certainty, and what else... all guns taken away, possible jail time, I don't know, but it's not good. This presents more of an issue without question. I get that there is likely a low chance of anything happening, BUT with that logic, why bother with a standard capacity magazine, just carry a double stack with a 17 round magazine, and since I like stiletto switchblades, fuck it! I'll carry one of those too because they'll both be concealed. Nobody is likely to check anyways right?

On a serious note, I'll need to think more about this. In the meantime If anyone can answer my previous question above, that would be helpful.

I cannot answer your question regarding Monroe. In NYS Parks however, it is only a fine.

Carrying in NYS Parks is Only a Fine at Most

But in the unlikely event that you get pulled over and in the unlikely event you are asked if you are carrying, your answer is no. Even if you are. You've committed no crime as far as anything else and they would have no right to search you.

They are not even allowed to ask you in NYS if you are carrying for a routine traffic stop.
