So are they going to start issuing restricted carry permits again? Because with a premise permit, you are still in violation of penal law 400 when it leaves the premises unless under certain conditions and a LEO from outside of NYC can arrest you for being in violation of the penal law.

nope, not yet. Pres. Trump needs to appoint one more Justice. Justice Roberts has decided to be the "middle-of-the-road" guy. He could flip/flop on the 2A, And im not entirely comfortable with Kavanaugh's approach to the 2A. If and when Pres. Trump is re-elected and RBG decides to either step down or she passes away, THEN IT will be time to challenge the Safe Act

I don't think this will affect the court hearing the case. IIRC, there was something said about this very situation and mentioned how it wouldn't negate the case.

Well SCOTUS may still hear the case on the basis it is a "harm capable of repetition". In any event there is no chance the Justices were going to issue a RKBA decision but instead decide on Commerce Clause grounds, so it would not have been that helpful.

I really hope that this does not negate the court hearing the case. The case could certainly make things better. This is just the city's way to try and prevent this case from having Federal level benefits for gun owners.

Following the Osterweil decision, a New York City resident who owns a second home elsewhere in the state may apparently apply to the licensing officer in that jurisdiction for a license to possess a handgun at the second home. The Rule, however, does not currently authorize a premises licensee to transport a handgun listed on a New York City premises license to another premises where the licensee resides and is authorized to possess a handgun.

Just with that it seems there is still standing for a case. Having to apply for two permits to be able to do something you are supposed to be entitled to?

I agree, it took 10 years top hear a gun rights case and this was it, do we not have enough f-n sporter rifle bans to assess, unless there is an AR15 committing an abortion good luck getting so-called "Conservative" justices to care about it.

The Court should still draw this and rule on it if I'm not mistaken (I could very well be) for the reasons @ArmedCorgi and @C3D posted.

@Burzum I have to say- NYC is so egregious it is a great place to start Is it not? We have been dying the deathbed a thousand cuts for a long time. Time to start patching them and taking our cake back.

Was there a vote? Was a law changed? Seems to me the case still has legs, all the city did was prove that the restrictions aren't based on any legal standard and are nothing but arbitrary "rules". Rules they can just as easily change back on a whim. Police where never meant to have this power. This type of shit is just as bad as ATF flip flopping every which way they want.

You have a very good point here. It’s a local administrative rule that can apparently be suspended by the police commissioner’s order. This is not how rights are administered and hopefully Scotus sees fit to teach them that regardless of whether O’niell (scum) is currently enforcing it or not.

Off topic but of relevance. They used not let NYS concealed carry license holders fly out of NYC in the past and technically as per the unconstitutional penal law 265 and 400, you weren't supposed to since your license is not valid in New York City and you aren't protected through FOPA since you are making a stop when you park your car and walk with the firearm. A circuit court outside of New York's jurisdiction already ruled that FOPA does not apply to air travel. New York City allows you to anyway in contrast to the penal laws.

Now they allow it. 2 months from now they may decide not to.

No way in hell I would ever fly out of New York City when they could change rules on a whim.

It's bullshit, at a course I took recently a man with a NYC premises permit asked if the Supreme Court case was going to make it harder for him to fly out of JFK with the handgun listed on his premises permit. They had let him fly out with it about 13 times prior..

Did the tyrants at NYPD licensing division give the OK for him to fly out of JFK under his premises license ? It looks more like the port authority police is ignoring case law check out beach v. Kelly to laugh at some libtard judicial activist logic.
