I’m not sure what you’re getting at here because everyone needs a marriage license not just those getting married in a church. It’s a legal document saying you’re legally married now. It’s like signing a car note together it’s a legally binding contract and all contracts have paperwork.

A couple who intends to be married in New York State must apply in person for a marriage license to any town or city clerk in the state. The application for a license must be signed by both applicants in the presence of the town or city clerk. A representative cannot apply for the license on behalf of the applicant.

why isn't the license / contract from the pastor of the church of your choice good enough .. get married and go file with the Town Clerk ..

some pastors actually do the legwork needed to authorize them to sign off on the marriage licenses, for just this reason.

But it has nothing to do with separation of church and state.

Marriage is a secular contract in the United States that affects how things like taxes, inheritance, and a whole host of other laws are affected. Thus the .gov requires you get its permission first.

If you get married in a church without the .gov paperwork it is, essentially, an unenforceable ceremony in the eyes of the State.
