Yes you have to run a new one but if that is put on hold I believe after the 3 days as per feds you can proceed, you have already met the NY requirement. It says nothing about waiting another 30 days or that it has expired just that you have to wait 30 days. thirty calendar days shall have elapsed since the date the seller or transferor contacted NICS. you already contacted them the first time says nothing about a second time for the same transfer

§ 400.20 Waiting period in connection with the sale or transfer of a rifle or shotgun. When a national instant criminal background check is required pursuant to state or federal law to be conducted through the National Instant Criminal Background Check System (NICS) or its successor in connection with the sale or transfer of a rifle or shotgun to any person, before delivering a rifle or shotgun to such person, either (a) NICS has issued a "proceed" response to the seller or transferor, or (b) thirty calendar days shall have elapsed since the date the seller or transferor contacted NICS to initiate a national instant criminal background check and NICS has not notified the seller or transferor that the transfer of the rifle or shotgun to such person should be denied. 40 § 3. Subdivision 1 of section 897 of the general.

Don't worry , NYS will fix that mistake soon enough.

Down here, I just show my CCDW, they record the number on the 4473, and I'm done. No NICS bullshit, no waiting, just pay and leave with my new handgun or rifle.
No bullshit, no drama, nothing. It shouldn't even require that much work/info. NOW, if I decide to buy/sell/trade among Friend's, then there is ABSOLUTELY nothing done. No paperwork, no FFL inclusion, nothing. The only caveat is that we have to reasonably believe the person is not a 'restricted' person. All of that freedom, and we still don't have 'blood running in the streets', or it's not 'like the wild west' around here.

Same in NC no fuss no muss. In and out as fast as it takes to check over the paperwork. You guys may want to take up making your own. No NICS required. I filled up one caliber card with guns I made. I pretty much trained the Jefferson County Permit staff on adding homemade guns to your license.

That's the way it should be. The background check on the purchase is BS! If your background was shit you wouldn't get accepted by a judge for a license to carry.
