No Restriction Upgrade Onondaga County Approved

As per a well seasoned locally based firearms instructor, and as per a highly regarded local law enforcement officer, if you have a permit with "restrictions" i.e. hunting and target, you are not guilty of even a misdemeanor. The issuing judge will decide if your permit is revoked but you're not going to jail.

As per a well seasoned individual, you would be wise to not fill people with an exaggerated sense of confidence when carrying on a restricted permit.
As a law enforcement officer, you would know that legislation is currently proposed to lawfully punish those who carry out of class.
Would you be willing to state your name in regard to your views on permit law?
Ie. will you let everyone go when you catch them with a loaded gun?

so if you have a PP you have to carry it empty ? what legislation or penal law gave judges the right to place restrictions ??

It is simply impossible to be charged with a crime that isn't in the Penal Law. What the Penal Law does say however is that the Issuing Judge can revoke your license at any time.

With that said, for that to happen...

1. You were found out to be concealing it. For that to happen, you didn't conceal it properly.

2. An LEO will have to be involved.

3. The LEO will have to believe that you were carrying outside of the restrictions and then decide to do something about it.

4. If he decided to do something about it, all he can do is report you to the Issuing Judge.

5. The Issuing Judge will have to decide if he or she will revoke your permit. It's up to him or her to act on it immediately or allow you to explain yourself.

For all those things to happen, you have to be made out, an LEO has to be involved, they have to believe that you weren't on your way to the range, hiking, ect, and they have to decide to get involved.

You almost never hear of these things happening because they don't and it's done everyday.

Nobody who says otherwise will ever find that you can't in Penal Law 400 to be charged with a crime. In fact, Penal Law 400 says that your license is valid throughout the state for carry without regard to employment or place of possession.

What does my name have to do with anything? Will you provide yours? I'm not "letting anyone go when I catch them with a loaded gun" because I'm not an officer of the law. What they do is up to them and up to a judge to determine if laws are broken. I'm just stating what I've been told. No one has ever been guilty of violating "proposed" legislation.

You have just described the benefits of a full carry permit in Onondaga County. Going to Walmart. Walking around your neighborhood. Etc. if you carry a loaded firearm under these circumstances, and you have an administrative restriction on your pistol permit, you are in violation of that restriction, and therefore subject to revocation or suspension by the licensing authority.
The sentence on the back of your permit stating that “all weapons to be carried concealed “ applies in a completely different way than an unrestricted pistol permit. Under an administrative restriction, you can conceal your weapons to and from the stated activities on your permit when the gun is locked, in a locked box, unloaded, and the ammunition is subsequently far enough out of reach and locked away that you can’t immediately load the weapon and you can’t utilize the weapon upon a moments notice.
You may encounter a local police officer that will let you go home with your loaded gun strapped to your hip when you only have an administratively restricited pistol permit for that weapon. But make no mistake, if you encounter a state trooper or an officer that strictly abideds by the permit law, you are in big, big trouble.
If you don’t believe me, just contact your local trooper barracks. They’ll be glad to coroberrate my tale.

Requests in regard to pistol licenses and specific upgrades go to the issuing justice in Onondaga County. Therefore, whoever issued your permit, is the one that will ultimately respond to whatever request you make.
Whom ever you spoke to did not tell you the right response. It’s probably better if you look up existing legislation than taking people at their word.

My issuing judge was Brunetti....he's retired. That's why I called and asked the permit office, as to who took over.
