NY Assembly ammo import ban bill introduced

Correct but there is a law that says they need to report sales tax to NYS and pay it. I do think some will oblige by this but they have no legal requirement to ask where we are from or keep a record and with shipping to NYS that’s rather hard to ignore.

But currently if you ship to an outside of NY address then the NY legislature now has a problem with that. This new law will end a lot of online ammo shipping to a NY citizen and stop out of state retail stores from selling. Not because the seller is obligated by a NY law that is clearly unconstitutional under commerce, they, the seller, just don't want the hassle or to take a stand on it and will police NY citizens for the state in refusal of service or purchase. That is why the measure could pass and any filing will get to SCOTUS in about 30 years. lol

But as I said above in a previous comment, this slippery slope of a law has endless revenue generation for NY's budget. Let your mind run free with controlling what NY citizen can purchase and from who. Would it be such a leap to restrict NY's from purchasing homes in other states and leaving the state? No.

I saw this coming years ago, so when online ammo wasn't an issue and was on sale. I stocked up,
I had enough to probably last me the rest of my life.

But I gave all of my ammo to a guy on the other side of town. During my tragic boating accident that would have killed ten ordinary men. All of my guns sank to the bottom of Lake Deep as Fuck.

So I figured I would give all of my ammo to another guy who still had his guns. I think his name was John Doe but I can't say for certain.

It depends on how you look at it. If I’m sitting at home and buying ammo on line did the sale take place in NYS or at the store in another state? I’m not sure how the tax collection thing came about but I’d assume they decided the sale was taking place in NYS since they collect NYS sales tax at that point. If it’s decided the sale is in NYS then one could argue NYS laws apply. I don't like it but that’s how It could be decided.

I am SO glad I got out of NY 7 yrs and 6 months ago tomorrow. I can buy a gun from anyone witout going to a shop and going thru a BGC and I cah buy a handgun with or without a CWP. With a CWP a gun purchased and no 3 day wait. Gotta love this state. Oh ya NO State tax either.

last i remember is if you bought something out of state

there was no sales tax unless the business your buying from has a office or store in NYS

if they have no physical presence in NYS ... no sales tax ..

but that could have changed ..

Not the case anymore. If you buy form anywhere and your shipping address is NYS they tax you regardless of there is an address in NYS or not. I guess it’s a use tax and not a sales tax.
There are very few places left anymore that do not tax every purchase made in NYS on line.
