Lawmakers Drafting Bill That Would Allow Social Media Checks Before Gun Purchase
NEW YORK (WCBS 880) – Two New York lawmakers are working to draft a bill that would propose a social media check before a gun purchase.

Brooklyn Borough President Eric Adams and state Sen. Kevin Palmer’s proposal would allow authorities to review three years of social media history and one year of internet search history of any person seeking to purchase a firearm.


“A three-year review of a social media profile would give an easy profile of a person who is not suitable to hold and possess a fire arm,” Adams explains.

The two are hoping to identify any hate speech on social media profiles, which are often revealed only after someone is arrested in a mass shooting.



“If the police department is reviewing a gang assault, a robbery, some type of shooting, they go and do a social media profile investigation,” Adams said.

There are some logistical concerns as free speech and gun rights complaints are likely to come up. Though, Adams and Palmer say it is doable and needed.

I'm curious about the logistics of his too. What if you claim no social media accounts? What exactly constitutes social media (Facebook, Twitter...NYGunforum.com?)? What if you delete your internet history? It just seems unworkable. Then again maybe that's their plan all along.

I said it in another thread on this topic and I'll say it here. They have no idea what they are talking about and have no idea how this would be executed either. This makes as much sense as the whole twice your guns capacity in ammo allowed every 90 days BS. As @livingston said though, if the dems win control of the Senate here in NY and Cuomo continues to be governor, then they will likely pass this. I don't think it would stand up to the public, but they may just MON to get around that. It wouldn't likely pass Constitutional muster and another member said it, I think it's too much for even liberal judges to go a long with. As of now the police need a warrant to ask your ISP for your history. For them to write an exemption that allows for them to check without a warrant is a lawsuit in and of itself. This proposal violates the 1st, 2nd, 4th and 5th amendments. They can't even get an ammo background check database together and they think this is going to work? This does nothing for public safety it only serves to intimidate people out of exercising they're 2A rights.

Delete anything it would be obstruction of justice ? ... Felony = no guns for you... Think of all the folks that would decide owning a gun would not be worth it....too bothersome or too dangerous .....Think of getting charged with a hate crime ... What is a hate crime ... anything they want it to be... Think back to the years of the KGB sending millions of folks to the Gulags on trumped up charges ...A neighbor has a dispute with you he goes to the police station and makes a false claim against you. Off to the gulags you go ... Now you say anything against anybody . group or political party... Hate crime folks ... You are sitting here saying it could not happen in this country ... A borough president is more like a NYC equivalent of a town crier. It's a ceremonial position devolved from back when the city was lower Manhattan.

To the obvious point, I think investigating officers are already free to look at any relevant open source information for a pistol permit if that is where their investigation leads them. Are they seriously going to ask law-abiding citizens to turn over their social media accounts for a mandatory fishing expedition? Have they thought that one through? (No.)

And if this is only for pistol permits then it has nothing to do with the panic of the crazed AR15 rampager.
