A little misleading. I don’t think it was struck down. On this particular case it was ruled unconstitutional and the judge refused to issue the eop. The law was not struck down statewide.

Justice Thomas E. Moran, of the Rochester based Monroe County Supreme Court struck down these laws in a 10 page decision, in a case entitled G.W. v. C.N., 2022 NY Slip Op 22392 (Monroe County Sup. Ct. 2022).

Also says this decision will be used to strike down the mental health checks in the safe act. This won’t last long.

SCOTUS ruled a couple years ago that the Red flag laws were unconstitutional. But people like Whorchul simply ignore the ruling, and passed these stupid, unconstitutional laws anyway.

But now we have a precedent, Next time someone gets nabbed for a EOP, they can site this ruling

I don't follow any of the threads, I don't watch any news, I don't really know what's going on anymore, and I could care less. If they're that blatant about flaunting the decision someone should sue them personally for damages. Their immunity doesn't exist if they *knew* they were violating your rights.

Yea I'm sorry to bear the bad news but it wasn't struck down. A low level judge said it was unconstitutional. It holds no weight in regards to anything. The next guy can be found guilty of the same tomorrow and it will be valid. Supreme Court is the lowest of state courts and their decisions do not set precedent. Happy new year.
