NY stopping issuing permits for around 7+ months??

I know there is a long thread, but this is such a massive issue, I created a new link - happy for it to be merged if required

So it looks as though, based on the attached, NYS will cease issuing permits for around 7+ months

If so, this must be the biggest constitutional breach of our 2nd Amendment rights ever

I believe it for sure.

Their scapegoat this time will be: "We need to wait for a decision on what will happen with these lawsuits and potentially redesign our processes." Or something to that effect.

My wife is taking the class in a week or two and will apply. She will apply and we will see what happens. If they stop accepting applications then I guess they stop but I can’t see how they will get away with it.

Simple answer, a court needs to force constitutional carry until the state is able to have a "reasonable" (yeah, I know) process.

Until the 2nd circuit (or Scotus) puts the hammer down, this shit will continue.

The "good news" is that the more things like this (no licenses for 7+ months), the more likely cases contesting it will make their way forward. The bad news is who we have as the circuit justice. "The wise Latina" (Sotamayor) handles the 2nd circuit. NJ is in 3, which is handled by Alito, so perhaps something crazy from there. Roberts has the 4th (including Maryland), Barret 7 (including Illinois), and unfortunately Kagan has 9 (including California, Hawaii).

"The request for a stay is called an application – a brief that summarizes the facts and history of the case and outlines the arguments why the lower court’s ruling should be put on hold. The application for a stay goes, at least at first, to just one justice, known as the “circuit justice,” who handles emergency appeals from the geographic area where the case originated. The circuit justice can grant or deny the application on her own, or she can refer it to the full court for all of the justices to vote on it. The circuit justice also may order the other side in the case to file a brief responding to the request; depending on the case, that brief may be due within a few days (if not sooner).

And what can you do about

If they dont issue permits for 7 months - what can you do?

Continue to carry until an issue develops and you get "caught" and then face the consequences of that - potential fine, jail and 100% certain job loss (at least for me anyway)

So I am afraid not a lot I can do about it really, without risking my whole livelihood


And my NY permit (issued by Oneida County) actually expires 10/1....................so this does impact me................which actually raises an interesting point

What happens with guns that you currently own and your permit expires like mine and they will not issue a new permit till 7/8 months later??

Thankfully I also have a CT and FL permit, so I can get around that, but what about guys that only have a NY permit...............are they going to come after you?

I assume you can’t walk into a gun store in NYS this week and purchase a fully built AR15 - shall not be infringed doesn’t really work, does it?

I also assume you don’t open carry in NYC - again fully infringed

If anyone has a state renewal up in the next year, RENEW NOW on the state police website. I don't know about after 9/1, but mine renewed no problem. You can renew up to a year early. It buys you 3 years until you have to take the course. I cannot imagine the landscape looking the same in 3 years, I think they will get smacked down hard way earlier than that.

As it stands right now, the law is in conflict with itself and some counties won’t issue a permit without some type of clarification.
For us current permit holders, our old permit will still be in effect as long as an application for renew was submitted and awaiting an answer.
It’s the new permits that have a real issue with the licensing offices and the new law.

Their mistake is thinking that the default is no permit.

If they have questions they should be issuing the permits until they get them answered, not the other way around.

When you're a conservative and in the minority you look for ways to comply. Just sit back and await your orders. Me, I'm land hunting right now in a red state.

I wouldn't worry about any recertification. Let them come for you. In my case the 65,000 or so permit holders in my county of nearly a million. That's 6.5%. We are clearly in the minority. They don't have the resources to do it anyway. They rely on you being compliant.

NY isn't a 2A state, its not even a hunting state anymore. Any firearms owned here are held by less than 10% of the state population. We have no public state ranges like in PA here. Hunting clubs and private ranges is all there is and there isn't a load of people looking to join anyway. We are a small community. You all know I'm telling the truth here. Yes, it's a tough pill to swallow. But face it, NY is done. Years ago it even outlawed militias for god sake so you can't even form one legally. lol

NY should be a lesson to all the other states in the union on what an out of control, self anointed bureaucracy can do to good tax paying citizens.


Everyone here needs to plan their escape. Housing and land prices will crash hard in some of these red states. Be ready to capitalize on it.

Staying here will only result in you getting tax, subjugated by political powers that buy votes of lazy people using your money.

It might later be invalidated later, and that would end up causing a mess, but until that happened it would be a valid permit.

If the authority made a mistake it wouldn't invalidate the permit.

If an arrest warrant was issued incorrectly, does the cop serving it get charged with kidnapping ?

I don’t think one would be immediately arrested and given time to turn in the guns. But what about the guy who don’t get notified and is visited six months later?
The comparison to a warrant isn’t a good one but if you want to use that, okay. If the officer believed the warrant was good at the time it was executed, he’s fine. Now, the officer is told the warrant is vacated but decides to execute it anyway, now he he has problems.

And if the person who’s permit is invalidated decides to move the gun out of state or something other than turn it in, it gives the state an excuse not to issue the new permit later.

I thought they specifically said "this is not a renewal, but a recertification." ie: just verify that the information is still correct.
so it actually is an expiration and renewal? Doesn't that violate all kinds of Court decisions?

so if your permit is due for its "recertification" between September and April, and you can't recertify, they cancel your permit, steal your guns, and mark you as a felon?

Why would moving the gun out of state be grounds not to issue a permit?


There are tons of people who store their handguns out of state while waiting for a permit to get issued.

Plus, the new SCOTUS ruling makes it clear that the State needs more than an excuse to deny. They need a reason that's clearly defined in the law.

Complying with the law in a way you don't like is not a reason to deny someone a permit they are legally entitled to.
