In this case, it would be considered “open carry “ which is illegal in NYC for any knife with a few exceptions.
It’s not the same charge as a gravity knife but they might have charged gravity knife as well.
The only person I ever ordered arrested for a knife (or arrested myself), was a guy in Manhattan who ran up on me while I was fighting his friend. I pointed my TASER at him and he screamed, "I have a knife!" It was so weird. At that point, he was going.
His friend was one of the best fights I've ever had. He knew how to grapple and took punches like a champ. But then he sued me and lost because we found video at the last minute which showed him throwing the first punch at a cop who asked him to get out of the middle of the street and stop screaming at 0300 hours.

When i was young my dad used to take me with him when he did jobs in the city. I remember being with him and a detective in an elevator in one of the co-op buildings in the Bronx and three teenage kids got on the elevator and looked at two guys in suits and a kid and one of them started playing with a switchblade not really threatening but making his point that he could mess with us.
My dad and the detective nodded to each other but just stood there. The elevator doors opened up and the kids walked out. As they walked out the detective just said "Don't bring a knife to a gunfight kid" as he moved his suit jacket to display his badge.
Both my Dad and the detective were carrying. I am sure that if i wasn't seven i would have noticed how tense they were but back then my dad was invincible to me so it was just another day at his office. I still remember the bulging eyes on the kids face as the elevator doors closed.

My guy was drunk. I think his booze-affected thought process was something along the lines of "I don't have a gun! Just a knife!" but all he got out was, "I have a knife!"
if it has a Locking blade, you could be in trouble!
thats why i got the Spyderco UK Pen Knife.
lest than 3", no Locking blade, it can be flicked open if you hold onto the blade, but not the handle.

the police Lost the case and had to pay damages.
i always dump it into my pocket when i walk not at work on the street or in the subway.

I might get one myself.
I carry a multi-tool instead . But when in NYC, I make sure that it, the clip or the sheath are not visible

A pocket clip is not open carry. Do they yank pens off people? He was arrested for a gravity knife. Notice if they always drop charges on these bull shit arrests. What a disgusting police force if they allow continued harassment over a visiable clip.

It is written in their law that a clip or sheath of a knife in public view is illegal.
It is a seperate charge than a gravity knife. One can have a legal fixed blade ( under 4 inches) and if the clip or sheath of the knife is visible, it is illegal.
That is the law the cop has the ability to stop the man to check if it’s a gravity knife because he already had probable cause on the mere public view..
The man in the video said it was illegal stop too. He doesn’t know the law as well as he thinks. The gravity knife charge is after the cop flicked the knife open. . It is a different law. He might have put the top charge on the arrest paperwork or the video maker just doesn’t know the additional charge because it is a lesser charge than the gravity knife one (Penal law CPW 4 vs a local law).
Despite the court ruling, one can still get arrested for carrying a knife in public view.
As far as identifying a pen vs a knife from a clip. Go look at the clips. Most knife clips are thicker than a pen clip and often the top of the knife is also visible.
It’s something cops look for even if we aren’t stopping someone for a knife. Any weapons when we are just talking to someone is an occupational hazard. Even in retirement I spot knives and guns on people where my non LEO friends and family don’t notice.
Just for a point of reference before you flame me. I have not said someone had a gravity knife when it wasn’t ( flicked it open by holding the blade instead of the handle) unlike some of the NYPD cops. I actually handed back a knife to someone I stopped just to find out that the NYPD cop who stopped him later arrested him for a gravity knife.

I would think so. It’s also legal to carry a screwdriver, a hammer, etc the last time I checked. It’s been a few years.
But local law is different than the penal law and one must check. It gets even crazier if one is on DEP lands because their “local laws” might apply as well. Or the town or village might have a local law..
It took a state law to authorize pepper spray and superceed local law. And penal law 400 has a local law exception for certain permits and local laws that ban firearms despite a license.
If you saw some of the local laws certain villages have, you would be shocked

Selling drugs but I didn’t get PC for the drugs, I would use the other violations of the law to remove the problem including “spitting” type laws. General business law is great against a front for a drug dealer spot like a corner store that doesn’t change over any inventory.. Sorry but you didn’t work where I had to or in the Times I had too.
Am I proud of every arrest. No. Sometimes you have to think of it like a pro choice woman before she actually had an abortion who is pro-life now. 99% of the arrest I made, I have no problem with. One or two sure.
And I have no problem with certain laws about arms. We can disagree.
Do you think a person can “bear” an unshethed sword in their hands and walk around a crowd mall without being stopped. A crazy look in their eyes and speaking in tongues. Do we have to wait until they swing before stopping them? How about just holding a knife in their hands?

How about Four 18 year old gang members carrying meat cleavers in open view. That’s okay? You're CCW carrier ? Do you have wait until they swung it at you or would you draw as they approached you and your wife to “talk “ to you.
Some might believe open carry can be regulated if concealed carry is allowed and others believe concealed can be regulated if open carry is allowed.

I forgot to mention I think folding knives in general should be completely legal. And I think the court decision was right.

i miss the days in the late 70's and early 80's .. toss on a back pack with the gun strapped on it and off for a 8 mile walk on the main roads here to get to the
hunting camp .. me and a friend .. .. nothing happened .. even got a ride from a stranger ..

Yes, but they must be declared crazy( a danger to themselves or others) or commit a crime. Other than weapon restrictions, in the situations I presented, the person hasn’t committed a crime yet,right? But a reasonable person would say they are in danger right?

Then arrest them for menacing, reckless endangerment, criminal use of a firearm or other dangerous weapon, etc, the mere possession of a weapon cannot be a crime, PL265 CPW is unconstitutional.
I sort of agree with you. CPW should not ASSUME that any item is a weapon, but it is an appropriate charge for when a weapon is used illegally. That is why it is CRIMINAL possession of a weapon as opposed to simply possession of a weapon.

Correct. Of assumed weapons. The law should never assume any item is a weapon. Even knives and guns.

I have to visit nyshitty in August and I’m not looking forward to it. Work trip and I’m forced. Freaking travel is already approved too.
Here's the problem... And "gravity knives were a hot issue I remember as a kid (70's) with those 007 knives that were huge, and with a little flick of the wrist, out it came! Was mugged by a skell with one of those.
Same here though, grew up in a different time. You want to carry a weapon? Fine, just don't break that 2nd law... Nobody knows it should know what you got, you don't show it off, etc. When I was a kid I got stopped plenty of times, and all but one time I can remember, was given my knife back. The time the beat cop took it, I was up to no good, they knew it, we all knew it, but they couldn't really prove anything. So after a smack in the head, and a stern warning, off I went, without my knife.
That said, over the years and dependent upon the situation, I've carried all sorts of weapons, knuckles, black jacks, expanding batons, taser, knives, belt sheaths, etc., and yeah, of course my heavy load out. Have I had a problem over all those years? Nope! And those days was all NYC...
Point is, I truly believe too much is made about nothing. Too much worry and anxiety over "what if's"... My only "what if" I worry about is, "what if I needed it, and don't have it?" That's the only worry that should be considered... Just chose the right tool for the job! Heaven forbid you need it, and use it, then you can worry. But trying to thread a needle and think you're complying with some silly safety code that became legal precedent rather than tool yourself properly will get you hurt, maimed, or killed. Just sayin...

NYC is where these cockamamie ideas are born... used to like going to the city, now I avoid anywhere I can't take my guns. Yeah I'm making a statement that probably won't make the city go broke anytime soon, but then again neither will I; traveling to places my gun is welcome AND likely much cheaper hookers! er... I mean hotels.

Even if you flick out the blade, it won’t lock securely into place without twisting the locking ring into place with two hands.
Since it doesn’t auto lock into place, there’s no chance in hell it fits the description of a gravity knife.
It’s also under four inches for blade length.
