NYPD is working very hard to avoid further RKBA cases by rigidly following guidelines from NYPD legal. WIth one bullet dodged and one potentially nuclear case now at the Supreme Court, they are not going to turn you into another potential test case.

Step 3: Move guns out of state to a friend or storage unit in PA.
Step 4: Move out of NYC or the state as a whole; you will be much happier.

If you ask permission to move your legally obtained and owned firearms out of state, of course they will say no. The reality is once you are no longer in possession in NYC or the rest of the state, there is nothing they can do. Unless they are at your door with a warrant or court order signed by a judge, get those guns out of state ASAP!

And as a smidge of extra caution, I'd pay cash for the storage unit so there's no record of it on your CC statement and such.

So Tuesday July 13th at 4:35 PM I received a phone call to which I do not know the number and I allow it to go to voicemail. I am then alerted to a message being left and in the meantime notice I have received an email from a "Detective" from NYC Licensing Division stating my phone number that I provided and that I have had for 12 Years now is a non working. Keep in mind the same number he just left a voicemail on. He requested a call back to which I immediately replied.

I wasn't sure if that was a good idea or not - I actually have only ever taken them to the range here in the city to shoot other then when I purchased them they have always been secured at home so hoping to get the attorney's advise soon. Thank you.

It’s actually pretty easy for law enforcement (and the NYS Department of Taxation and Finance) to track your whereabouts these days, thanks to cell phones. They will know within 5 minutes where you have been staying. I am sure that the Detective who called the OP has not yet taken the time to do this, but the truth will come out.

What I was getting at is what brought this on in the first place? They aren’t randomly tracking people. What triggered the probable cause for a judge to sign out a warrant for phone tracing? I suspect there is more going on here than meets the eye. What’s that saying about a scorn woman? Just a thought.

LOL - NYPD in my humble opinion needs nothing to trigger them other then there balance of power. Like I said this has been a relationship for 5 or more years so I am not sure who would be scorned? Any ex-girlfriends have long been out of the picture. But point taken.

I have taken plenty of professional training where everyone not in a coma passed with perfect scores, that doesn't mean they understood shit. Most places send you to training to cover their ass and say you were trained, if people weren't passing they would be pissed and find another trainer.

*Everyone* in this thread has told him to engage the best lawyer he can find. Most have given excellent suggestions. I would wager those lawyers would agree with the "store them out of state" plan. Asking them about it is certainly excellent advice.

I think you seriously overestimate the frequency of theft from storage units.

I wouldn't store them in the cheapest place I could find, but there are plenty that would be safer than his apartment.

If at this point he then denies be she will take over from there. She also indicated getting a legal FFL transfer to a FFL storage location would be a good idea for my peace of mind and if they do deny and then coming looking for them I have the legal paperwork needed to show where the guns are. So I will keep all updated.... I'm kind of hoping for a denial so that I can sue at this point>>>> Thank you all again.

Excellent. Happy to have helped. FFL transfer is a great idea. It’ll keep your house from being ransacked at 5 am. I’d be proactive and send them a copy of the transfer ahead of time so they aren’t getting that warrant when the deadline comes to surrender.
