Keep in mind, a legal decision is not made by the responding officers. Legal decisions take place in the court room. If some DA feels it needs to be decided in court you will always FACE charges. One of the greatest blows to legal carriers was when USCC had to leave NYS because of the NRA settlement. We lost that legal protection and support.

Unfortunately, in this state property is not justification. Once the two were outside the store, pursuing them and even what the prosecutor will call baiting them with continued emotional discussion pushes it outside of the justification zone. Serious injury or death to self or others. Once they were outside and appeared to be walking away, the justification ended. The laws in especially the City favor the unlawful. He will not win this case. At best he will plea out.

USCCA has been known to NOT support its customers. They have abandoned their clients when facing criminal charges.

Thieves were thrown out. Thieves returned, kicking, punching & shoving.

Shop owner was fighting them off with gun in hand and gun went off.

Despite it being an accidental shooting, he was justified to shoot.

He was outnumbered, that provides the disparity of force necessary for justification.

The really galling part is they only charged his attackers with petty larceny, and not for assault.

to get a NYC permit didn't you have to show a really really damn good reason ,, like own a jewelry store so you can get a permit to defend your

diamonds in the glass cases ..
