It would seem there's become a new standard to which people of good character or acting in self defense are now being prosecuted above the actual criminals. This tells me the powers that be have lost control and need to do two things: Go after any who dare not allow them to "handle the situation" and pressure for more resources (money, man-power) and in the face of the huge number of Officers that have retired/quit about all they can do is go after innocents that'll plead to some reduced bullshit charge just so they can get on with their lives and stay out of Prison/Jail.

It’s going to get scarer than that. Someone will be the next Kyle Rittenhouse. They will prosecute for political reasons .
They free criminals like the bad guy’s girlfriend who stabbed the good guy in this case. They refused to charge her.
The scary thing is when the people will know they wont get justice from that DA, people will take justice into their own hands.

That is a point I am afraid of. And the collateral damage or innocence people hurt as a result of such actions.

No, it’s illegal to possess in NYC in any capacity. It’s contraband on its face. The item is vouchered as evidence if the person wishes to fight the ticket in court. Then it’s treated like illegal drugs in the sense that when the case is over, its destroyed. If the law is overturned, they have to return the item or the person can sue for compensation.
If the person found with it, had stolen it, and the actual owner could be determined, and that person lives outside the city—the owner could get it returned to him.

Targeted or not I think there is a point here being ignored that we should all be able to agree on that isn’t quite right. If acting on your situational awareness and this happened to you , what would you do. He wasn’t exactly some little kid out playing with his ( squirt gun) He was an 18 yr. old adult pointing a gun ( albeit a toy) at some random person at 1:30am in the morning! If the government takes private property without a conviction, or compensation, then it's theft.
You can wrap it in whatever rulings or anything else you want, but that doesn't change the fact that the NYPD stole some kids squirt gun.
This isn't even the most egregious example, but it is the same thing as the departments who declare a pile of cash "a public nuisance" and just steal it so they can spruce up the break room.
Departments that do that sort of thing are as bad as the criminals, maybe worse.

What would I have done? I guess what would you have done? Certainly I hope that answer isn’t met it with deadly force. Remember he was short with it and it’s a gel ball not a bullet. If it was a BB or pellet gun I get the deadly force situation, but certainly not in this case. There’s no reason for me or anyone else to think my life was in danger.
As for me and what I would have done. I’d have accessed the situation, place my hand on my forearm ready to draw IF need be, called the police to report it, and walked somewhere safe like a building or whatever was open and well lit. Does this mean whoever wouldn’t have followed me in there no, but at least I’d have reported it to the police and if they continue to follow then they are escalating it. Hard to say since we don’t know all the specifics, but deadly force isn’t justified IMO.

Many things are illegal and many of them are ignored. If you walk by a junkie shooting up are their drugs and needles confiscated or does the NYPD just walk by them? How about public nudity, lewdness, or people showing their naked body parts to kids at the gay pride parade? I’ll bet those are ignored, but they will confiscate something that has no reason to be illegal in the first place. This ban is absurd to begin with so for them to devote time and resources to this is appalling.

That’s basically what happened in this case and he chose the wrong guy.
It’s a safe product if everyone is wearing eye protection. But these strangers getting hit aren’t.
And if one is getting caught with one of these things in NYC, they are using it in a place they shouldn’t be using it . This isn’t someone’s backyard we are talking about.
