Makes perfect sense. The state steals money from the insurance companies for screwing over their customers, the insurance companies in turn request from the Dept of Financial Services a rate increase which is approved, further screwing over the customers.

Damages and recovery should always go to the victims. The state keeping damages is BS. It would be like having your car stolen and then when the police recover it the police just keep your car for themselves.

The victim here isn't the state, it's the people who had their data stolen and now are at increased risk of identity theft, etc. They should be getting the money, not the fucking state.

All that really needs to be done is to make these companies properly liable for their data breach security failures. The root cause is the fact that it's cheaper for them to pay pissant damages than it is to pay for proper data security. Until that changes data breaches will continue to happen since it's the cheaper option. To them, losing your data is just a financial business decision. You bear the cost in terms of financial risk, they make the profit by aggregation and selling access. The formula needs to be changed.

Realistically the only people that do security are these big infosec companies anymore, because individual companies don't want to be liable. So they outsource it to someone who pays out the ass for liability who can "take the fall." Crowdstike quality infosec is cheaper than securing the data.
