NYS now makes kids 12 and up sign a health care proxy for parents to see medical results

My son has a DR appointment coming up on Monday and it’s a new doctor so they warned us about this. I’m not sure if it’s new or whatever. They warned us because he may need to have a risky surgery on his ear to repair a malformed mastoid bone that could leave his face paralyzed. They said if we don’t do this proxy we will not even be allowed to enter the exam room with him or ask questions. I have no boost this is for transgender surgeries and abortions. It’s absolutely ridiculous

I would check into that, is it state policy or is it that particular "health" group? If it is state policy, think about all the in school clinics. Our local district has a "health" and dental clinic that allows access to K-12. I am removed enough I do not know about current policices re: parents and the kids getting accesss to the clinics.

You are the parents and legal guardians of all of your childrens' interests. All of their interests.

Tell the doctors to pound sand, and call a good attorney.

I also suggest that you call your local and state representatives and give them an earful, but as a practical matter I know that some "representatives" aren't worth a damn, so that option may be better or worse depending.

So 12 y.o.s cannot enter into a legally binding contract. If they sign something it's not binding.

So when they hand you a document sue the Dr office for breach of HIPPA or whatever policy NYS is siting.

I'm sorry Salt, but that's total bullshit. You own a car. You can drive it. You have access to other Dr's if you're compelled to do the right thing for your kid. I travel an hour and a half, each way, for my specialist. I had organ removal surgery an hour and a half away. My wife stayed in a hotel for 12 days right by the hospital.

If you're being told something you don't like by your doctor, DO SOMETHING ABOUT IT.

Oh, one more thing I forgot to add above. There are a plethora of local doctors (specialists) and plenty of hospitals in between my locality and the specialist and hospital I chose. I didn't have to go an hour and half each way to treat my diseases or perform the surgery. I didn't like the answers the locals gave me. I searched until I found the one most capable of extending my life with both quality and longevity.

That being said, NEVER waive any of your parental Rights. You're dealing with medical doctors and the State of NY. Factor in how insane both NY and the medical industry have became since WuFlu.

Neither of those institutions are people you want to yield an inch of legal ground to when it comes to your children, especially children who are minors.

My wife and I had to deal with a few things over the years, but we were firm and took measures to protect our family. We had officials and/or "professionals" lie to us, or try to buffalo and intimidate us, so we replied with a "hell no," and if that didn't work, with lawyers and/or our representatives as necessary, and those assholes backed down.

You have every right to know everything about your child's health and care, make decisions for him, and so on, without a freaking proxy. ANY medical doctor or company that is telling you that you have no right to be in the exam with your 12 year old or ask questions is a damn liar.

Anyone that tries to coerce you to jump through hoops that revoke your power and rights as parents is not someone to be trusted. Anyone who tries to separate you from your 12 year old child in such a manner, is a threat.

That’s what we’re doing now. We are traveling an hour and a half each way to visit this guy. I’m in Buffalo and he’s in Rochester. Next closest is Cleveland at the Cleveland clinic and the wait is insane. Of course we didn’t find this out until Friday and his appointment is Monday. I’m doing what’s best for him and he will sign it so it doesn’t matter in the end. I just thought people on here should know. He needs to be seen and I can’t keep kicking this can down the road. His ear drums and hearing are already damaged and possibly beyond repair back to normal hearing levels. When his ears fill with fluid and his ear drum ruptures it’s very painful. I’m trying to prevent this from happening again.

Thanks for that. I will have to look into it because I couldn’t find what it was called. This is great information. Appears to be federal so nothing can be done about it for the immediate time being.

Funny my wife had to go get copies of his images, no problem, I guess I should have just tossed the kid the keys to get it himself. What if you have a high deductible plan and the kid makes the decision to do something? Get a fucking job and pay for it then right? This is wrong on so many levels. You have no say but you’re responsible and have to pay for it.
