Under the Expanded Polystyrene Foam Container and Polystyrene Loose Fill Packaging Ban, (link leaves DEC's website) effective January 1, 2022, no covered food service provider or store (retail or wholesale) will be allowed to sell, offer for sale, or distribute disposable food service containers that contain expanded polystyrene foam in New York. In addition, no manufacturer or store will be allowed to sell, offer for sale, or distribute polystyrene loose fill packaging (commonly referred to as packing peanuts) in the state.

That's not an accurate description of the requirements. The composing req. is only if there is an organics recycler nearby, and it's given to them to handle. It's a dumb law, but they aren't going to be composting in the back of your neighborhood restaurant


Effective January 1, 2022, the NYS Food Donation and Food Scraps Recycling law requires businesses and institutions that generate an annual average of two tons of wasted food per week or more must:

donate excess edible food; and
recycle all remaining food scraps if they are within 25 miles of an organics recycler (composting facility, anaerobic digester, etc.).


This law does NOT include:

New York City (which already has a local law in place requiring the diversion of food scraps from disposal)
Hospitals
Nursing Homes
Adult Care Facilities
K-12 Schools
Farms

Why not reduce, reuse and recycle the Styrofoam?

Do your part to save NY and be eco friendly. Soak the banned Styrofoam in gasoline so it can be dissolved into smaller volumes and reused for a great fire starter to burn more of it. It can be fun for the whole family. Show Albany your support!

If you get the right proportions, it becomes a highly flammable but very sticky substance. I believe they used to call it fu gas. Would really suck to get covered in it while penetrating the perimeter. Hmm. Send me all your packing peanuts for "recycling"

Im in! As much as my dog misses plastic bags I can live without them. The same goes for styrofoam cups and food containers.

Finally a "ban" I can get behind and support. Now that the killer plastic bags have been eliminated, we have to address the elphant in the room. I for one, am sick and tired of being attacked by hordes of blowing styrofoam as I am driving or walking down the road. There you are driving along minding your own business and suddenly without warning a styrofoam coffee cup blows onto your windshield blocking your view as you hit the brake causing the car behind you to slam into your rear end sending both cars into a tailspin careening off of a mountain to a fiery death. The resulting forest fire causes mass destruction of woodlands and pours tons of carbon emissions into the air causing global warming that causes the icebergs to melt and the seas to rise. That is why I bought some future beachfront property in Albany NY. If the rising seas don't work out, then I can use the land for a landfill of styrofoam and all it cost me was a couple of healthy campaign contributions to the politicians in Albany. Besides, what if Covid lives on styrofoam?

The "generation" that has chosen the word "sustainability" as a hill to die on, it the same generation that has never had to sleep in a hot sticky bed without airconditioning, probably see's dialing a rotary phone as too much physical effort, has to go to a gym to sweat, spends twenty seconds in the cold, walking from the exit to their car or Uber driver, carries a baba to hydrate everywhere they go and insists on a lactose-free double decaf espresso late' with extra sugar-free sweetener just so they can take a selfie holding the cup. They have never had to butcher meat and will become totally dumbfounded when they don't see it wrapped in plastic on a styrofoam platter. HOW DID IT GROW?

They are so smart I call them dicfor's. Because they don't know what a dic is for and which bathroom was designed to accommodate said appendage. Yeah! I am supposed to listen to them because they have been "educated" by the Department of Education.
