We had a brief by a NYSP trooper back in May and he told us the tint laws do not apply to out of state vehicles. Being on a Military base you can see how this question would come up. I have not heard of anyone with out of state plates up here getting ticketed for tint.For whatever reason, it doesn't apply to tint. I've seen it held up in court numerous times. We used to write them all the time on the illegally operating cabs in Brooklyn.

Just by random chance, I have seen it applied in traffic court to have ticket dismissed and the officer reprimanded by the judge for recurring equipment ticketing of out of state vehicles. Maybe they stick because its traffic court, and if the guy even gets a lawyer they arent going to spend any time on the case ?I wonder if the "operating out of class" charge made it possible to uphold the tint. Now that I think about it, I can't recall ever writing a tint summons without writing that also. Not to mention, a lot of those out of state registrations were expired anyway, so maybe at court that is treated as an unregistered vehicle.

If the defendant doesn't bring up the out of state exemption, I'm not so sure the judge or prosecutor would either.....
