I just read that no charges will be filed.
If someone else present had been armed, they would have had a good case for a justified shooting once he drew. Thats why i say don't draw till you're about to fire. The moment you draw everyone else has a legitimate claim to be in fear of their life.This does go to show you why you don't want to fight crime alone . He had no back up, no radio contact ,no way to notify anybody where he was, or what he was up against. He unknowingly at first,put himself into dangerous situation where it might have ended badly for him had somebody tackled him before or while he went for his gun. Im not saying the guy was wrong , but I think it was bad judgment on his part to continue. As far as the shot is concerned , it was obviously negligent discharge as he squeezed one fist the other tightened up.I don't believe there was any intent to scare or harm anyone .
