The Stewart’s near me is always swarming with NYSP due to proximity to the POS ORISKANY training center.

I haven’t been shot or arrested yet.

And you know something? All the millions of people that travel to and from the range or hunting grounds with an illegally loaded rifle in the car (in NY a loaded rifle means just having the rounds nearby) haven’t been hassled by LEOS either when the LEOs became aware that they had a rifle.

Sometimes stupid laws have to be ignored.

Personal story time.... I have a 44 mag revolver with scope. I carry it in a bandolier chest rig. I only hunt private land and have never run across any DEC or anything. I'd be perfectly fine carrying like that on state land though.

I used the same style holster with my TC Encore on the left and a regular duty holster for my 686 on the right. Getting checked by DEC was always a treat. Other hunters with shotguns or rifles had to get checked for loaded rounds in the tube or chamber, handgunners got a free pass. Listening to the others bitch about it was great.

All I know is that I have been doing it for years. By me, the police wouldn’t bat an eye if they saw someone at the gas station open carrying during hunting season. I also do work around my property open carrying and no one has ever said anything.

It must be legal.

According to the law, yes.

15. “Loaded firearm” means any firearm loaded with ammunition or any firearm which is possessed by one who, at the same time, possesses a quantity of ammunition which may be used to discharge such firearm.

And according to the DEC, a rifle is a firearm for their purposes.

Rifle - is a firearm with a barrel length of at least 16 inches with rifling in the barrel that uses metallic cartridges.

I was under the impression that if ammo was stored in a separate location from the rifle/shotgun while transporting them, it was okay while driving? Guess not?

You have to read law as it is written, not its intention. That's how SCOTUS usually gets it wrong and most others.

Definitely not in penal law, it's a DEC thing that other LEOs recognize. I always open carry during deer and coyote season and it's never even been brought up by NYSP or Sheriff Dept. I wouldn't expect one with the Sheriff Dept but was leary at first about the SP until I had one step up to the coffee counter next to me one morning when I was was getting a refill. I think he was jealous......mine was bigger lmao
Seriously though, every LEO I've encountered during hunting season never acted like it was a big deal.

As per the sheriff's Dept. While in the act of hunting yes you can carry your pistol in a chest rig. After hunting you must follow the rules set aside for your particular permit.

steuben county at thier pistol eficiency course 2 or 3 years ago it was Captain Tyner that actually answered me. Sheriff Allard and 2 other deputies were there.
