A person, not a police officer or peace officer, acting pursuant to his special duties, who equips a motor vehicle with a radio receiving set capable of receiving signals on the frequencies allocated for police use or knowingly uses a motor vehicle so equipped or who in any way knowingly interferes with the transmission of radio messages by the police without having first secured a permit to do so from the person authorized to issue such a permit by the local governing body or board of the city, town or village in which such person resides, or where such person resides outside of a city, or village in a county having a county police department by the board of supervisors of such county, is guilty of a misdemeanor, punishable by a fine not exceeding one thousand dollars, or imprisonment not exceeding six months, or both. Nothing in this section contained shall be construed to apply to any person who holds a valid amateur radio operator's license issued by the federal communications commission and who operates a duly licensed portable mobile transmitter and in connection therewith a receiver or receiving set on frequencies exclusively allocated by the federal communications commission to duly licensed radio amateurs.

Both of them use frequencies outside of the ham bands.
Any US citizen or permanent resident ham can join.
MARS used to relay messages to and on behalf of military personnel. They don't really do that anymore thanks to satellite comms and the internet.
Now they provide interoperability communications between the Army National Guard and Air National Guard forces and civilian state agencies.
Civil air patrol also uses frequencies outside of the ham bands. They are basically an air force auxiliary. They do things like search and rescue and coastal patrol.'

but just about all Amature radios recieve the police bands ..

Something I was always curious about. Capable of receiving is one thing, but what if you actually have said frequencies programmed into your radio? Or if they hear transmissions you are listening to from your vehicle?
My Icom is also programmed with them for Broome and Cortland Co. I usually turn it low or off when any LEO are near, haven't taken the time to take the test yet lol. I've been super busy. Poor excuse though, the test doesn't take long, but I also hate driving to Vestal lol.Beats me, ain't nothing I'm worried about. I have mine programmed in with all the frequencies I could muster up, and it's always scanning with squelch. Almost always stops on Putnam/Westchester 911/NYSP.
