Permit Question. I’m stumped.

My buddy recently moved from NYC to Orange County.

He is being told that to transfer his guns from his NYC premise permit to his Orange County permit, he will have to ship them FFL to FFL.

Does this sound right? Has anyone dealt with this issue before?

I know the premise permit thing is the problem, but they are his guns, in NYS. If Orange County adds them to the permit when it is issued, he should be able to just drive them up in locked cases. Not to mention, I said I’d just do it to avoid any complications.

Im no ffl, but that does not sound normal. As long as orange county adds them to his permit he should be covered under federal law for traveling with his own firearms across the imaginary border of nyc and nys.

He should just produce his make model serial number etc etc BUT i guess he has no ny state piatol permit, does he. Nyc permit is not a ny state permit is it? That may be the rub.

If he has an Orange County/ny state permit he should be able to just add the guns.....again you are dealing with stupid so ymmv.

I would go to the permit office in person.

That’s what I figured. They shouldn’t have to see the guns in person if he shows the NYC permit and the paperwork from when he bought them. The NYC permit is technically valid as all others in NYS, it just has restrictions. They should still accept it.

If your friend has the NYC premise permit and his guns are added at the time of application in Orange, he just needs to pick them up in NYC using a lock box to transport out of the city. I wouldnt think that an FFL is needed. He just can't transport them until he gets his Orange permit.

He couldn't show the guns to them if he wanted to. OC PP office is in a gov't building. Metal detector and xray machine to enter.

I'm not a lawyer, LEO, doctor or politician, but it seems to me if he gets his OC permit with the handguns listed on it then FOPA should protect him for transport to his new home. As long as he doesn't stop for an overnight stay in the shitty, stop for food in the shitty, stop for gas in the shitty, stop for a traffic light in the shitty, stop to breath in the shitty or turn his head to look for traffic or a pretty girl in the shitty he should be ok.

NYC Premise Permits aren't recognized outside of NYC. Orange County doesn't issue Premises Permits for him to transfer over. So he needs to get a new permit in Orange County just like everyone else applying brand new. That'll take a while so in the meantime, an FFL will have to hold his guns until he gets an Orange County Permit. It'll take a while to get one. They aren't just going to transfer it over since he has no carry permit to transfer over. He has to go through the whole shebang for a carry permit since Orange County doesn't issue Premises Permits and he can't keep them at home without a permit.

Let me ask another way... Let's say this person has legal residence in another State, and also NY, OC... and wants to add those firearms to his permit, is the clerk saying the only way to present a firearm to an license/amendment is via FFL? How ridiculous... It isn't a transfer!

That would work if he keeps both places but the minute he moves out of his city place and transfers his driver's license over, the NYC permit is no longer valid.

Perhaps he can hold on to both places but it'll be at least a year before he gets the orange county pistol license.

Then he's good. Just keep them there until he gets the Orange county license.

Some of this may be a problem? Your friend has to establish residents in OC ? Are the pistols co-owned with his parents? If not they are in possession of of these pistols and his new residents is OC not NYC? And even his brother--in-law and sister can not be in possession of these said pistols? (Even being cops)

So he is applying for a NYS pistol license in OC and has pistols that are not co-owned? Is this not breaking the law right at the start of the process? His pistol are in someone else's possession? So having a FFL hold them or someone who co-owns them seems to be the only way to do this?

Unfortunately he doesn't.

So he made a bunch of phone calls today. OC said they don't care how the guns get there. They also said there is in fact an expedited process since he already has a valid permit. They recommended that he voucher the guns with the NYPD until his permit is issued, then said they don't care how he gets them at that point. So I'm going to keep them here at my precinct since it's his former resident precinct anyway.
