Legally? This will go down as a good shoot on the behalf of the Police.
Seems from an outside perspective, with a very short video, I think I would have done things a bit different.
If you all don't mind, I will share a small story, an incident I was involved with years ago...
I was sent to Germany in 2007 as an MP in the Ansbach DE area. I had received a call in regards to an American Service member who was, allegedly, pointing a gun out the window of his car at German Nationals. We were able to obtain his on Post residence through the vehicle registration.
We arrived at his barracks room, knocked on the door and announced ourselves as Military Police. My partner and I had our sidearms in hand, mine was at the ready, my partners was at his side. The Soldier opened the door and had the gun in his hand. We ordered him to drop the gun and get on the ground, he hesitated a bit, ordered him a second time and he complied.
The "gun" turned out to be an airsoft gun, the Soldier was quite drunk and did not understand our commands, it never crossed his mind that what he was doing was all that bad. We did not shoot him, hell, we never even charged him. I made him stomp on the air soft pistol until it was completely smashed. We informed his command of the incident and never reported it on the blotter.
Many different results can occur from a single situation. All depends on who responds to said incident.
In this case, the officer deemed it necessary to shoot the game player.
The game player deemed it necessary to answer the door to the Police knocking with a gun.
I've also heard from that "acquaintance" I know in Germany, that the cops there have far more discretion similar to what you're describing. At least, the local cops do. They tend to keep people from doing stupid things rather than just looking for reasons to charge people.
