Pistol applications

A family member of mine recently received approval from the Nassau county pistol license bureau for a pistol permit. He went to purchase a pistol and must wait a period of time upon a background check.

This was in mid December. The pistol store said they had to resubmit his background check because it was over 30 days. Is this normal and how long can a background check take?

Unless there was a delay then normally shouldn't take more than 3 min sometimes its busy and can take 10 or so min, but should essentially be "instant"

But if they are doing it online vs the old over the phone, I belive after like 24 min the page will time out and it's the same as a "delay"

And now thanks to FUAC if someone gets a delay the FFL must wait 30 days to hear back to proceed otherwise they can't complete the sale.

Problem is the FBI will only keep doing anything and respond within 3 business days after that they don't give a shit..

When they run a NICS check it will come back as either Proceed, Delay or Deny. It sounds like your family member got a Delay.

As far as federal law is concerned, a Delay that exceeds 3 days can be treated as a Proceed and the gun shop can do the transfer. Unfortunately NY modified that a few years ago so that period now extends to 30 days in NY. It just so happens that after 30 days, the check expires as far as the feds are concerned. So yes, he needs another NICS check run. And yes, he could theoretically be stuck in an endless Delay loop.

If he gets another Delay, he should request a UPIN (VAF) from the FBI. Appeals and VAF | Federal Bureau of Investigation

Happens to many people, could be any number of reasons, could be a common name and someone with that name needs more looking into.

Or it's 2021 and more guns are being bought at record numbers then ever before and they system is being overloaded like never before

Keep in mind, don’t assume a UPIN will solve all of your issues. I have one and was denied my last 2 purchases. That, and it will take you a minimum of a year to get one. FYI

Problem is it only last 30 days if he keeps getting delayed this could theoretically go on forever. It shouldn’t but it could.
Tell him to go back to the ffl and get a new background check done. This should hopefully solve the issue. Make sure he uses his full middle name, address and all info is up to date. If it’s a common name a social security number can help.
Mine take less than 5 minutes all the time but I’m the only person in the USA with my name.

All three of my FFLs with OVER 100 years of combined gun selling have never seen a UPIN denial. Also, if denied with a UPIN the appeal process will be much quicker......like 2-5 days.....even these days.

If this was a few months ago id say to email Trump, it worked for me. After waiting almost 3 years for my denial appeal, Trumps people cleared it up in 5 days.

Ever sense I received my UPIN, my 6 or so purchases have taken less than 3 minutes.

Yes, it’s true, in all likelihood, a UPIN will solve their problem. I was told the same thing and my first 5 or so after getting it were “proceed” in minutes, and then one day “denied”. Just wanted to point out, that as my luck would have it, I am the exception to that rule and I can’t be the only one.
And , yes you are correct , the appeals after are pretty quick with a UPIN, 10 days was the longer one for me. And the other was actually changed to proceed after about a week into doing the appeal.

Probably best to go with the suggestions further up in the thread and get the UPIN. If that doesn't work, a lawyer.

Because there are too many idiots who vote for politicians who make it as absolutely difficult as possible to practically exercise our rights.

But remember liberals say how easy it is to buy guns......
