It might be time to lawyer up.

I'd be tempted to have your wife do a FOIL request for her file and try to see what they came up with to bring this on. Again, probably better done with legal counsel.

If it's just because (they can), then it's arbitrary...

Can't tell you what to do, other than get a lawyer to respond denying the request without those requesting it to show cause and notification that any arbitrary denial of the permit will be met with a legal challenge via appeal...

Fuck that...

Do you need a psych evaluation to vote? Like WTF! Again... Is there something missing here?

Yeah I would consult a lawyer. Someone with 2A experience. If they've encountered this, they may know exactly what to write.

The fact you (will) have a lawyer, and a letter is sent, may be enough to make them drop the requirement in this case because they know it's arbitrary and unnecessary -- and they'd rather it not go to court to stop them from pressuring other people in the future.

I am very interested in finding out more details around this, and why the police are requesting a mental health eval.

They can ask for what ever the hell they want. Their is no actual process laid out in NY law. They could require you to have Covid vaccination.

This is where these gun rights groups, that we throw money at, should step in and raise holy hell. Yes, you now need a lawyer, and, you should not have to foot the bill, these money grubbing gun rights groups should be falling all over each other trying to be the first to help you out!
You might try a WTF to the issuing authority on your own just to get a feel for the situation, be careful.

I had a psyc eval once when joining the PD in 1970. A real psychiatrist named Muhamid wanted to know if I look at my poop. WOOT! How do you answer that? So I said of course. I mean WTF! I should have said, Only if I have eaten corn. Sorry to make light of your sit but good luck. We are a Soviet State in the USA.

This is a slipperly slope.... So no real documented process for application of PP so they can ask for whatever they want?! wow.....
once applicants start complying so to speak becomes a precident and keeps going and once they can slip in one thing...what will be next...

And the may issue state of NY will deny you.
You get a lawyer, the state drops it but youre still out lawyer fees.

It was not in OC, but I had a strange call for additional info (for the pro 2A judge) from the investigating detective during my application. The detective knew there were no issues but had to ask and the judge probably did not even read my name on the application since he has known / respected my family his whole life. It was a crazy question, an outlandish concern and easily resolved. From my experience, there is a chance the background check had some strange anomaly and a calm simple phone call for background information "to help resolve the potential specific question" could be an option.

My understanding is that is the intent. If you've been confined and unable to leave willingly to the hospital for a mental health reason is what they're concerned about.

Anything outpatient, where you can leave / don't sleep there, is basically a normal doctor's visit or isn't disqualifying for most jurisdictions outside of NYC or Long Island.

That's my understanding too.

I think that each county has a fairly wide latitude on what the process can be to get a permit. I wonder if this is a harbinger of what's to come. A little surprised it's Orange too. Would've thought it'd be a more traditionally restrictive county like Westchester for example.
