Pistol permit question

I am now 25. Back when I was 17 I was a passenger in my friends car and we got pulled over and all charged with possession of marijuana and possession of alcohol. After completing an alive at 25 class and an acod. The judge said that the records would be sealed/ expunged ( I can't remember which) like it never happened. Fast forward 8 years and I'm looking to apply for my c&c in Monroe county. I have great references and have been passing regular drug tests for my job for the past 6 years. Really just curious if anyone has been in this similar situation and gotten approved or denied and is it worth it for me to apply? Or will the sherrriff just automatically think I'm a druggie and deny my application

There are a bunch of us from Monroe County. As long as you disclose the details of what happened, I think you'll get your permit. It's been a while (8 years) and you can honestly say that you've been passing drug tests. Look for a letter template online about "turning your life around" and make sure to include a letter explaining what happened and how you've grown up and changed since then. As long as you were never charged with any felonies, I'll bet you will get your permit.

Thank you for the advice. I wasn't sure if I was able to attach any documents with the actual application or not. They have a section to explain what happened but it is only one line long which obviously isn't long enough. And no I have not. But I do know that on job applications And things of that nature I am able to check no for ever being arrested or anything like that. I know they go deeper into it than a job does but at least I know it's not on my record

Try calling (or stopping by) the clerk's office and asking them about attaching extra papers. I'm pretty sure you can attach other papers to the application and say something like, "See attached paper" on that one line.

I'm glad something minor you did years ago as a kid isn't still biting you in the ass.

Thanks for the help! I will call them and see what I can do. I tried to call a 2a lawyer in the Monroe county area and he wanted $150 just to answer my question. I'm going to apply and if I get denied I'll request to have a meeting with the judge and explain the situation

I had a appearance possession ticket issued to me when I was 16 yo, same thing as you, I was not in possession but got a ticket. Did my community service and paid my fine, was told it would be sealed if I didn't get in an more trouble for a year.

Now I don't know if this is something you should do but, I never disclosed it. No problems approved with restrictions in Onondaga County. A few years later applied to have restrictions removed and was granted a full carry permit.

Thank you for the info. I was considering not disclosing it because I know it's not on my record but I've heard mixed reviews. Some people like yourself didn't put it on there and had no problems and others didn't and were denied immediately. The most common thing I've been hearing is to just put it on there because they're going to find out anyways. I'm hoping that with my honesty and explanation of what happened the sheriff will see that as a good thing and approve the application

Disclose EVERYTHING -- all sealed records become 'unsealed' during the pistol background search.

Yeah that's what I've been reading online from other people. Now to just find out if I can add a typed letter to the application explaining what happened

It's not up to the sheriff's office to approve or deny your application. Your file is forwarded to one of the county judges that act as a pistol licensing officer. He or She will either approve or deny it; not the county sheriff's office.

I know the judge has the final say but I thought that the sheriff decides whether or not the application even gets to the judge or not

The sheriff's office submits ALL applications to the licensing officer for review.
