Got some pistol questions for a friend of mine. He has an AR15 type lower that he purchased as an other last year. He has never built it into anything. Now he is thinking that he would like to build an AR15 pistol. How does he add to his permit something he has already possessed?

second question is, can a manually operated pistol have a magazine outside the pistol grip? He is looking to build a bolt action AR15 pistol that has no gas system and would like to have a detachable magazine. Is this possible under safe act?

The best option would probably be buy another stripped lower from an FFL and register it as a pistol then and there. use the other one for something else. That is to say if the FFL isn't scared and fuddlike of doing such a transaction. If they don't, they don't deserve his or your business anyways. In terms of the bolt action rifle being built, yes, you can have it configured however you'd like legally in NYS, but you need to still use 10rnd mags.

It depends on what county you are in.

Some you can just go down to the clerk with a serial number, manufacturer and caliber and it's a done deal.

When I made my AR pistol I just took a picture of the serial number on the lower with my phone, the clerk looked at it long enough to enter it in the database and handed it back, that was it.

Other counties require a notorized letter from god that he personally bequeathed the lower to you on a mountaintop in front of a dozen virgins.

All the SAFE act AW rules only apply to semiautomatic firearms, if it doesn't have a working gas system your AR pistol can have whatever features you want.

How do you figure ?

The AW definition for pistols in pl265.01 only includes semiautomatic weapons with detachable magazines.

(c) a semiautomatic pistol that has an ability to accept a detachable
magazine and has at least one of the following characteristics:

Most people making legal AR pistols do it by making the magazine non detachable (but keeping it semiautomatic).

But making it not semiautomatic (and keeping the detachable magazine) is just as valid an option as well..

Well imagine a 450 bushmaster AR15 pistol or an ar10 pistol in 308 with a 3-4 inch barrel. Would not have to worry about a gas system being able to cycle, plus imagine the size of the fireball.

"Because" is justification enough in my book. I was just wondering why you'd care about fixed vs detach (again I take no position on the legality)- point of fixed is to have features; point of detach is to change mags quickly.

When you have a manually cycling gun with detachable mag, you have slow rate of fire and high rate of reloading, which seems counterintuitive to me, regardless of Johnny Law.

Hell you could even get a 10.5" barrel without a gas hole drilled and your still g2g

The safe act interactive tool says not semi auto no assault weapon. Bolt action is GTG.
