I think it matters. Maybe not in the conversation of whether he was right or wrong, but I still think it matters. The kid reached for his waistband and the homeowner likely has proof of that on his security cameras. It matters more to the mindset of the person breaking into the truck than anything.
If he had a gun we know what he was thinking, if he didn't, then there's a conversation that could be had there.

Possibly, but NYers are so scared I'm not sure why they even carry a gun. This fear, most of the times, is made up.
