Question about Recertification

Here it is, § 400.00 section 10 subsection (d):



Note that the "will expire in less than one year" is preceded by an "or". My reading of this section says that anyone with a license that was issued 3 or more years prior to the day this law takes effect will have to recertify within one year.

My re-cert is due in December 2022, I was thinking of getting it done early to avoid having to attend 16 hours of classes that haven't even been defined yet (much less offered by any instructor) before the end of the year... but from what I think the law says, that's a no-go.

Mine was due Jan 2023 so I went ahead and did it three weeks ago on-line and it went through.

I hope the new Law gets repealed, but just in case I'm going to have my Handgun Safety and Hunter Safety Instructors credentials updated... While I do not support the Law or the premise of it, I am going to make preparations to instruct provided I'm allowed to.

Not that these power drunk , garbage legislating fools care; but it is logistically impossible to have every permit holder in the state re cert with these new onerous requirements in one yrs. time.
There just aren't enough instructors / classes to accommodate the numbers.

I think once the property up north is sold, Im not coming back to this shithole. I love the state, but the assholes ruining it for the citizens is to much. If I do come back this way, I'll blow through on my way to Vermont, Nh and Maine.

That's been many of folks point. There is no way it can happen. Way too many people.

FWIW, my local instructors are getting full classes and can't keep up as it is with NEW applicants...

And I'm sure somewhere there's the State making note of its requirement to notify permit holders of their expiration!? Especially in those pieces of plastic that have no expiration? And if your permission bestowed upon your by the State were to expire... What then?

Actually, guys, I think I have even worse news. I was reading through the law the other day and ran across a portion that talked about recertification. If I recall correctly, it stated that anyone who already had a permit would need to recertify within 1 year of the day the law takes effect.

If I read and interpreted that correctly, that means that anyone who recertifies before 9/1/22 will need to recertify again by 9/1/23. I'll go dig through the text and see if I can find it again. brb

As previously posted, the new bill puts all recerts on a 3 year recertification schedule retroactively

According to a couple lawmakers who voted againts the bills, unless Huchol's law is overturned, no one gets 5 years between recertifications. Those who recertified in 2021 and were informed renewal recertification was due in 2026, because of the new law are due in 2024. Those who recertified or were permitted in 2022 before the bill takes effect will be due in 2025.

About a week or so ago, after reading this thread, I figured I would recertify early just to get it out of the way, despite all the Hochul horseshit. My recert date is in this coming November, so I'd be a few months early.

I visited the NYSP website, pulled up my info, and none of it reflected amendments made after my "start date", getting my new and improved plastic permit. My wife is in the same boat. I tried to update stuff that was in error, but a window would pop open and tell me it wasn't official until the NYSP blessed everything...even my weight was wrong and I tried to correct it...no go! So why bother?

So I called the county sheriff's office and said, well, we followed the rules, came in and did all the forms, and got our new permits that reflect all the latest info; so what gives with the NYSP? The answer given, the state is about a year behind on getting info up to date.

Closer to two years behind if you ask me. The sheriff's office said don't worry as long as you're good with us. Yeah, right.

My reply: 2022 is five years past the 2017 Safe Act bullshit, and the online information from the NYSP is sketchy, and your phone is going to be ringing off the hook with calls from pissed off people like me...and you are not prepared to handle anything, let alone what may be coming.

So no early recert for us, but the county says don't worry, they love us.

Does anyone know if the 18hr course can be done by a NRA instructor, yet, at a local range or does it have to all be done by a S.P. instructor where ever they do them? If I read it correctly(probably not) The NYSP will just give an outline of what's needed(No one knows yet what that is) and then it can be done at a range

I don't even think the SP know what the process will be and it is a little over a month away from being enacted. I spoke to a guy who does both the basic and live fire. He told me the live fire he does is half the time. I am hoping if they just take some certificate that I can just get signed off and call it a day. I don't see how else they can prove you took the training outside of a certificate.

What I read is you’re right about the first part but recertification early for you would allow you a year just on the off chance they make you get the training and what not before.

Yes, in my case, recertification before 9/1 would likely give me 12 months instead of 4 months to get my training classes in. Of course, they won't be defined and offered for a while, and it will be tough to find space in the few classes that were offered... all part of their plan, I'm sure.

One other thing: I don't think it's an "off-chance" that they require training before recertification. I think it's a guarantee.

What you posted is correct, but I do not think it is complete. I think it fails to consider the additional text I cited, from the law itself. Read that text very carefully and tell me what it says to you.

From what I’ve read, that if your permit was issued three or more years prior to the enactment of this bullshit law yes you only have one year to renew your permit. But you cannot renew your permit until you have the training course, the training course isn’t even set up yet ,probably won’t be for months which will only leave a handful of months for tens of thousands if not hundreds of thousands of people try and recertify before the year is up.
I do believe this was all part of the plan that they are going for as many permits to be revoked as possible and once permit is revoked thanks to the safe act you also lose your long guns to.
I know we have five lawsuits so far against this bull crap but I want to know how long does it take to get in front of a judge? When are we going to see an injunction if ever?
Just to be on the safe side I am making plans to move my stuff out of state if it comes to it.
