I'm attacking PL 265 and 400 as unconstitutional. 265 make is illegal to exercise a constitutional right (possess a handgun) without a license, then give the licensing officer the power to grant or deny that right on a case by case ad hoc basis using his own interpretation of terms and judgment. Since this involves to possession of a handgun in the home it burdens the "core" of the right and must satisfy strict scrutiny. It can't. I need an expert witness who can look at the stats and write a report that PL 400 is largely ineffective at preventing crime. NYSRPA, NRA and SCOPE have been no help.
