Trademark only applies in cases the use is likely to cause confusion.
If you try to open a restaurant called "big boy" you'll likely infringe on Bob's Big Boy's trademark.
But if you decide to sell a rifle named the Big Boy, your fine, because consumers aren't going to confuse a rifle with a burger.
But our modern legal system is so fucked up, they can just outspend the guys and win that way despite no real case.
