Someone's getting a big false arrest check for Christmas.

I assume this guy didn't have a permit, so that was a crime before the safe act. So what is the deal with 10 rounds in a mag, I thought that it was over turned? The NY attorney generals office is useless, they won't give you any info on what is the maximum number of rounds you can have in a mag. I had once called the NYSPD and they told me that the decision about the number of rounds had been over turned by a higher court. Anyone have any FIRST hand info?

Agreed. I dont recall limits on the 10rnd magazine when the courts booted the 7 round limit..only at ranges and that!? It was just booted to 10 rounds period.

It's just a bill that takes the seven round BS out of the Penal Law. But... it never made it out of the codes committee, even in the Senate that the so called Republicans control until the end of the year. It should be just basic house keeping considering that the 2nd Circuit threw it out. They just don't have the integrity or the balls to get it done and so you get bullshit charges like this.
Granted, it looks like they were up to no good even without the 7 round crap. The Criminal Possession of a Weapon charge probably means that either no one had a permit or that gun wasn't on their permits.

I called the local State Police barracks and they told me 10 rounds in a magazine was legal. That was today.

at the very bottom of the news report .. .. shouldn't that have been first . LOL .
so what led to the back pack search .. its a traffic stop ?? ,, fking news reporters ...
damn youngins .. only drink at stop signs ..
and stop blazing up in the car ..

Simple traffic stop. Should have ended with a simple ticket to the driver. But, as we can see, it went further. Wonder why? Maybe due to the fact that the handgun was found in really, really plain sight.
The driver has no pistol permit, and the gun had some other issues. Much more to this story, as usual.
