As I have stated time and time again, the PLCAA is the target and weak point in the battle for gun rights. PLCAA is the link that holds the chain together. It is the glue whose bonding strength will be tested. Notice the companies who produce vaccines are immune from lawsuits. This is a game of pick and choose which industries will be protected and which will not be. The way things work, the defeat of the PLCAA for gun makers does not necessarily mean that just any industry may be sued. This is a matter of selective application of the law and everyone knows that. There is a very good chance that PLCAA will be defeated without threatening other industries such as pharmaceuticals, automakers, food producers, etc etc etc. This battle for the defeat of the PLCAA will be fought until no soldier stands to fight it. And it will test the meaning of uniform application of the Law. It will be a fierce battle. Count on that.

Pathetic? Maybe. But the lower court decision was held as questionable as the higher court revealed. That means not all judges and legal minds agree with the foundational concepts of the PLCAA. There will be a battle ahead, even if the appeal loses this time. It's one of the last resorts of the Left and they will pursue it.
If they lose the appeal and others continue to sue gor the same thing, at what point does this become a frivolous lawsuit?
Also, cant one of the high courts strengthen the PLCAA and protect it from lawsuits?

It's a state court interpreting federal law as it applies to the state law. A federal judge will override any decision that is not favorable to the gun company. If not, congress will pass one that will end this nonsense
