I'm in Erie. I'll have to figure this out as I bought an Aero upper and lower pair that I wanted to build into a pistol but got it from my FFL in the usual manner. I'd be pissed if I can't have it added as a pistol on my permit. This is the type of shit that makes otherwise law abiding people break these pointless "laws"

Depends on who you ask. My understanding is that the ATF said that since the brace is not designed as a stock to be shouldered, if you do, you are not using it as designed and is ok.
I have also heard that certain NYSP feel that a brace is a stock and therefore a SBR regardless. But our "laws" aren't based on someones feelings.
What if I bring it up to get a cheek weld but not touch my shoulder with it?

Is it legal to hunt with in shotgun only WMU's? Pistols are permitted in those areas. My 300 yd deer pistol.

I don't know if he still is but I believe @Celt was looking to sell his Angstadt 9mm. But if memory serves its a rifle not a pistol length.
I would love to build a 9mm pistol length but having to topload it- no thanks.
Easy enough for him to walk in and buy a non compliant pistol, building though I think it might cause the same sort of confusion we go through.
This is why you need to find the right ffl first. I've had several pistols in Erie county. All Erie county cares about is if you have the correct receipt stating make, model, caliber, and serial. You don't get that from buying a stripped lower though.
So that's the trick. Thanks. I will need to find a good FFL that knows the games that need to be played.
The gun store I was at apparently didn't want to be bothered with it.

That's clear as mud (not directed at you, but these stupid rules). So if I bought it configured as a pistol already I'm fine. If I want to use a stripped lower to build one I'm SOL.
You're right - celt is selling a rifle. Nice looking setup though.

my FFL wrote "multi" for caliber...the clerke asked what caliber upper i bought (didnt ask for receipt) and they put 556. Was pretty easy. At least one person behind the counter knew how to add ar lowers to the permit

IDK. I bought mine as a stripped lower. That's why they wanted the info on the barrel. Although not listed on our permit, barrel length is required. I just provided a copy of the receipt for the barrel showing length and caliber along with the receipt for the lower showing make, model, and s/n.
I was told to check the box for "frame only"
At the time, I wrote to the ATF with 5 questions. They answered 2 or 3 I believe. Now, I have an opinion letter addressed to me confirming the brace designation is as designed and not how it is ultimately used. Therefore although shouldering/ cheek weld is not recommended it is not a violation of federal laws according to them.
You can use the stripped lower, but need an FFL receipt with the with the required pistol info. Not all ffl's will do this for you though, and it's better for everyone planning on a pistol build to have this clear with their ffl before getting the lower.
I am very confused. I talked with some big guns guys at work that really understand the laws and they are a bit confused.
It seems the more that I read, the worse my mind understands all of this.

The problem with ATF is the phrase "at the time" in your post.
Not saying you're wrong, etc., just pointing out how capricious it is to let the executive branch write the laws via rule making, instead of the legislative branch being very specific when they write the laws.

Very True....I am fully aware of the rulemaking process of the government. Just pointing out, if there is ever an issue, while is far from likely, a letter would hold more weight than nothing.

It basically boils down to this. Every county is different as far as building a pistol goes. That’s why everyone here is giving you different information as if all counties have the same procedures. They don’t.
Some take your word and register a stripped lower even though it isn’t a pistol yet. Some don’t and make it more difficult by requiring this receipt and that. Those counties that make it more difficult will require a bunch of hoops and trips to the county.
To avoid all that, buy a completed fixed mag pistol, register it, and since you are an LEO, remove the mag lock device once it’s on your permit. Or, just build a pistol with an 11.5 inch barrel and add a fore grip as I’ve been saying. Once that fore grip is added, it no longer is a pistol. That eliminates registering and asking permission and all the other BS that everyone here is telling you to do with multiple trips to your pistol permit office and all the questions and misunderstandings that go with it.
It’s a no brainer. Why register something when you don’t have to if all you have to do is add a fore grip to it? You are an Leo. No one is going to fuck with you with that AR firearm.
The confusion comes from the stripped lower, which is not a pistol, or rifle. You need the proper pistol paperwork to go to the county with. Most ffl's can't "manufacturer" a pistol. An FFL is releasing a stripped lower to you, and has no idea exactly what you are going to build it into and has no control over what you do with it- which is why most of them won't do a pistol.
In your case it's easy enough to buy any ar pistol you find - wether it's at Wolcott guns, or order online from out of state wether it's NY compliant or not. If you want to build it your FFL needs to know exactly what you're building, and provide a pistol receipt - which I've said not all are willing to do.

To be specific....a vertical foregrip added will no longer be considered a pistol. A foregrip like the Magpul AFG will still be considered such. If memory serves correct, not sure about the AFG2 since there was no opinion letter at the time I was researching. It is essentially the same so the argument for the AFG2 would likely be the same.

I've been actually thinking of building an 80% pistol(s) for a while now. I'd like to get the easy jig gen 2 whenever the hell it's available again. Mine will be of the ghost gun varieties however.

True. BUT with the 11.5" barrel it will be over 26" in total length and therefore not a pistol as per FEDERAL definitions so the vertical foregrip would be legal without NFA registration. There still is the very gray NYS "law" though.
Agreed. Best bet imo. 10.5" pistol with AFG if you want some type of foregrip.
