Yeah. I should have added- the reason this case fails (among others)- who has standing to sue who and for what?

In the particulars here, the state would have had to intervene on the part of these guys since it is their law they enacted to pre-empt/nullify the feds.

Inasmuch as I would love to see NFA vanish (and Sullivan too, for similar reasons), this ain't the case that gets you there. From a constitutional perspective, I am actually way more interested in where these abortion cases go because it cuts to the heart of the problem with respect to states vs feds and the 10th itself.

Well what in the constitution details abortion? Life, liberty and the pursuit of happiness??? Pretty thin I think. One could use that to argue anything and in a somewhat unmeritorious way. This isn't an argument for or against abortion in any way. I'm just looking at this from a what's written in the law and not the perspective of one persuasion or another.

No, that's my point and I probably made it poorly.

Even Ginsburg has admitted Roe is a shoddy piece of jurisprudence. Abortion is not a right at a federal/constitutional level, and it should have been left to the states (gay marriage too- and that was doing well enough in its own right winding its way through the court of public opinion far before the Oberfgell decision).

Knocking down Roe/Planned Parenthood is way more important to me as a constitutional matter, regardless of how one feels about abortion.

It is good to see, though, that the state of Kansas filed an amicus brief in the matter. It's their law, they ought to be the ones to take it up with the court.

Just as I predicted. They will strike down some over the top NYC local ordinance, but no dice on anything of substance. This is why I no longer care about either political party or conservative movement. It is all about pulling the wool over our eyes, especially younger voters or political newbies.
