SCOTUS DECISION JUST NOW: THE ATF IS IN BIG TROUBLE...


Today, the U.S. Supreme Court in Sackett v EPA issued a major ruling cutting back on the authority of the EPA and by extension all federal executive branch agencies such as the ATF to enact laws via regulations. The Sackett opinion contains powerful language that can likely be used against the ATF in various contexts including in the ongoing legal fights over the bump stock ban and the pistol brace rules. This is from 10/22 and has already been discussed. I doubt it will help us and a work around has already been established. This was rules this way because the EPA didn’t have the authority to regulate carbon emissions, well guess what the ATF has the authority to regulate firearms.

The ATF does not have authority to regulate firearms.

They have authority to enforce specific laws about firearms.

The EPA was given authority to write regulations about what constitutes pollution for instance. That is an authority to regulate (that the constitution doesn't permit IMHO, but it is regulation).

The laws the ATF is given don't have those loopholes. Deciding what is a gun was never a power granted to the ATF by the legislature. It was always spelled out directly in the legislation itself.

They actually intentionally *increase* the CO2 in greenhouses to improve crop yields.
