Maybe on a newer than today serial number but there are hundreds of millions of guns that could and probably do not belong to the last atf transfer. They cannot arrest everyone. Well here's the thing in New York: To legally and lawfully Transfer a firearm to someone outside your immediate Family, it has to go through a FFL who will conduct a NICS Check for "no more than Ten Dollars". The FFL/Dealer is the receiving Party who must log in gun, and log it out. therefor, the non-dealer does not fall under this, nor does the Licensed Collector. (according to the release I read, that I cannot cite at this moment)

ATF did a study on ARMSLIST sales.........................ATF determined that typically 1.3 million Americans are acting DAILY, as unlicensed dealers in guns, BY SELLING their own guns............even though when the gun is sold, it goes to/thru an FFL, at the receiving end, for NICS........

People are making a profit on selling their guns.......... so they need an FFL, as they are in the business of making a profit, or not..................so they need an FFL that they cannot have.........ever.

ATF further says, that there is no number of gun sales, that triggers the need for an FFL, and even one gun sale on GB or Armslist, makes you an unlicensed dealer....in the business of making a profit..or not.

It is not the sale that was done legally thru an FFL/NICS,.............BUT THE POSSIBLE MAKING OF A PROFIT, OR LAUNDERING MONEY.............THAT makes you an an illegal dealer in guns.

Long and short of it.

I believe that the ATF and Congress overstepped again. If you can make your own gun, you can sell a gun, if it is sold thru an FFL with NICS check...

In 23 years this maybe struck down as unconstitutional...........Congress passed it............ or it is an overstep in ATF authority of the Congressional Law.......... to prohibit legal guns sales, on a flimsy might.......... "make a profit" , supposition/authority . Capitalism is legal.

ATF was once under the IRS/Treasury, and DOJ Depts..but all hated the ATF revenoouers.

Biden/Obama/CCP, are the motivators here...to ban 425 million guns and the sales of over one million new guns a month, and one million resales each month..NICS CHECKS PROVE IT, for the last 48 straight months or more. They are desperate to choke off the supply.

I always sell on consignment thru a LGS, to aovid the hassle..costs me 15% but I am not a gun dealer, and I hate the hassle.

They just make more people buy guns with this BS. I was at PSA in Myrtle Beach Sunday buying a pistol. The gun counter manager told me might be 20 minutes or so for the BGC to go through. They were backed up about 50 checks. They were busy. He said they had done about 100K the day before. Pushing more stuff out of the White House just makes more gun sales.
