I thought Senator Ortt was very well spoken. His comment regarding the lack of statistical data regarding the length of the waiting period was a very strong point.

Hochul response was essentially, "we have evidence, seriously, we just don't want to share it." This demonstrates the weakness in her argument. Hopefully the majority of viewers are intelligent enough to discern this truth.

The "Red Flag Law," as bad as it is, has at least some built in "due process." Respondent is entitled to a hearing before a Judge. A lot more "due process" than the Nassau County Police Department policy, which is they can take all of anyones guns when ever they like, for as long as they like with no "due process" at all. We have four cases against Nassau County pending now. Two have Motions for Summary Judgments pending, another will be pending shortly and a Motion for Preliminary Injunction pending. So far the Courts have mostly let them run rough shod over the citizens.

The bump stock bill is moot. Also my opinion of bump stocks is they are useless for a serious shooter. Still they make a good toy.

The "social media" bill has very serious 1st, 2nd, 4th, 5th and 14th Amendment concerns. Usually 1st Amendment right are "jealously guarded" and any violations that tend to have "chilling effect" on those rights are struck down. Except in NY if you want a pistol permit. The argument will go like this: This law has a chilling effect on what I say on social media or what websites I view, because I'm afraid if I say or view things that the pistol licensing officer might find offensive, a pistol permit will be denied. Their response: "Don't apply for a pistol license and it will have no effect because you won't have to disclose unless you apply. You are in NY, you have no right to a pistol or permit." Therefore this law does not violate your rights, because you have none where guns are concerned.

Post-deprivation, perhaps. If you look at the current bill, it allows for revocation orders to be applied for and issued ex-parte. The respondent may have absolutely no knowledge of what's going on until the knock at the door. Or perhaps in some areas of the state with police forces that have an inferiority complex, the no-knock at the door.

29 INVESTIGATED, firearms possessed by such license holder, email address

32 electronic form if so designated by the superintendent of state police.

33 Failure to recertify shall act as a revocation of such license. If the

34 New York state police discover as a result of the recertification proc-

35 ess that a licensee failed to provide a change of address, the New York

36 state police shall not require the licensing officer to revoke such

37 license. IN ORDER TO ASCERTAIN WHETHER ANY SOCIAL MEDIA ACCOUNT OR

38 SEARCH ENGINE HISTORY OF A LICENSEE PRESENTS ANY GOOD CAUSE FOR THE

39 REVOCATION OF A LICENSE, THE NEW YORK STATE POLICE SHALL, AFTER OBTAIN-

40 ING THE LICENSEE'S CONSENT PURSUANT TO THIS SUBDIVISION, AND OBTAINING
