During the altercation, Marvin shot one round in the abdomen area of the 41-year-old victim with a legally possessed Glock. Marvin remained on scene and surrendered to Troopers with out incident.
Marvin was arrested and processed at SP Machias. The victim was taken to Erie
County Medical Center for injuries and is in critical condition.
Marvin was arraigned remanded to Cattaraugus County Jail on $50,000/100,000 bail.
Marvin gets FUAC .. not a cricket the gun owner was drinking ,.. FUAC ..
BTW .. how do you legally possesses a glock .. what if it was a HighPoint or S&W or a Kimber ....
where is the photo of the victim .. ?? his size to the legal gun owner .. ??? and more ..

Marvin walked away toward the corner of Washington and Monroe streets while Janesz and Janesz’s brother stayed behind talking with Marvin’s designated driver, according to Murray. Janesz’s brother then said an expletive and charged about 20 to 30 yards toward Marvin, causing Janesz to follow.
“I saw both brothers push the defendant down to the ground from behind, and then I saw Janesz fall into a snow bank, and at that point I saw the defendant pull a gun out of his hip and shoot (Janesz),” Murray said.
I can see how Marvin would be in fear , to what reasonable degree it’s hard to say .
I find it odd that there was no mention of the BAC for the two men . This scenario wouldn’t it be standard to get the BAC , at least from Marvin ?

If this was police officer performing his duties preventing an attack from a guy who was just kicked out of a bar it would be justified would it not. Equal protection under the law.

Technically, having/carrying a firearm (legal) in an establishment that serves alcohol violates the parameters of his CC permit (at least the counties around Rochester). Add in the consumption of alcohol, ability impaired, dead perp, he is probably SOL.
