The weapon was legal, The assumption by the officer that it wasn't, was his probable cause. Or he knowingly didn't ask for a permit as an excuse to search. The first question the officer should have asked is Do you have a permit for the weapon. ?No gives him PC. Yes doesn't . ( unless he runs it) If he had a trunk full of coke it would be thrown out. .
First, he never even gave me a reason for pulling me over, despite my asking. Second, why was I asked to step out of the car for a minor traffic violation, especially one to which there was a good reason given ? Third, why did he pat me down without telling me he was going to do so ? Fourth, why did he not ask if I had a weapon ? I could go on, but the point is that once my rights were violated, the whole thing snowballed. Bottom line is that he wanted to be a "drug bustin' hero" and I just happened to be the perp. It just didn't quite work out that way.
About two months later, I happened to meet up with LEO #2. He recognized me or at least recognized my vehicle. He told me parts of the story I did not know. According to him, cop #1 pulled me over because I turned at the red light. The fact that I sat there for a bit without a turning signal on and then turned drew his attention. He had been watching the intersection for drug sales and thought that I saw his cruiser which caused me to get spooked and leave before the group of people made their way to me. So to him, the chase was on.
Still, NONE of that gives probable cause. A vehicle travels through a rough neighborhood, stops for a red light, and then turns right on red. What exactly is suspicious about that ?
I say he had visions of being a "hero", and/or a God complex. Couple that with his perception of "contempt of cop", and we have a fabulous recipe for rights to be violated at will. For him, the ends absolutely justified the means. I know for a fact that the POS is still on the force, too. I also know there have been complaints and accusations made against him. Why is he protected ? If I was one of the "good" cops, I would want him GONE. RIGHT NOW. He gives ALL cops a bad name. Still, he is protected and still on the job. What a great country. Lie, cheat steal and expect respect because you have a badge. Not in my book.
