No new trial for Sheldon Silver until he petitions Supreme Court

ALBANY —Sheldon Silver will be able to make his case to the Supreme Court before prosecutors get a chance to bring a second corruption trial against him, a federal appeals court ruled Thursday.
Prosecutors opposed Silver’s motion, saying they want to bring a new case against him now in part because a key witness, Dr. Robert Taub, is an octogenarian. Judges sided with Silver, who has until October to formally ask the Supreme Court for a hearing.
The Democratic politician will remain free before the court either grants a trial or decides not to hear the case.
“The court recognized the significance of the issues we will be asking the Supreme Court to review. It halted the trial court proceedings to allow us to do that,” said Silver’s lawyers, Joel Cohen and Steven Molo.
