Was there an excise tax on guns in historical context? If not they can’t do this. Maybe all excise taxes will be found illegal under the equal protection clause. Wouldn’t that be great?

I think the bigger question is will the military pay the 1000% tax to buy the AR-15’s or will they exclude M-4’s. If they exclude the true weapons of war won’t this moot their points?

Well, this would a fine example of the proverbial slippery slope. Stuff like this is election crap. I honestly cannot see SCOTUS split on this. The idea that in order to exercise any part of the Bill of Right a tax must be paid to the government, is ridiculous. Such legislation is meant curb the practice of it because those in power disagree with 2A. Imagine that in order for some to practice free speech they must be able to pay a 1000% tax on all methods. Tax on paper, ink, pens, internet access, power, PC and any tech because they have been classified as a threat. Oh I know they're some but they are a very small segment. Again this is about NOV as they know the turn out and they need to counter it.

We pay tax on every gun purchase already. We also pay an 11% excise tax already to support conservation. Look up the Robertson-Pittman tax act.
