The New York State Police's position is that the rifle must remain in its original configuration with all 50 year old parts. I called FFLs after speaking to the NYSP and they told me they'd have to have Colt verify that all the parts were at least 50 years old. That seems to be the hard part. Colt does have a serial # lookup for the receiver, but who knows what happened to the rifle over the past 50 years.

I'm also not sure I follow how it is you have to transfer and THEN register it. Would someone else be in possession of it while waiting for the registration?

I still say build one. Check out Brownells and JSE Surplus. There's also a company out there (name escapes me at the moment) that specializes in period and model-correct components.

It appears that the FFL transfers it to you and then you register it within 30 days of the transfer into the state as per PL 400.16(a). I haven't done so myself but know of someone who did that with a 50 year old+ M1 Carbine.

Building isn't a bad idea, I'll probably do so after I get an AR-10 built.

You are correct. I find it hard to believe that FFLs did such diligence to prove that assault weapon M1 Carbines had parts that were all 50 years old.

Apparently not though if the post above is believed- you can't swap parts (which I find a little far fetched but given this was from the hotline I have little doubt it was actually told to the OP).

Ya I'm still not convinced that's the case. I don't see how that works with the letter of the law. Once registered it becomes a "legal assault weapon". Therefore you can get anymore assault weaponish so all things are a go neglecting NFA items.

Right, as far as I can see from the statute, the state would have to redefine manufacture to mean changing out parts. Then charge someone under PL 265.10:

1. Any person who manufactures or causes to be manufactured any
machine-gun, assault weapon, large capacity ammunition feeding device or
disguised gun is guilty of a class D felony.

Of course there's no definition for manufacture, but the deface/gunsmith definitions seem to show a difference between manufacturing, altering, assembling:

7. "Deface" means to remove, deface, cover, alter or destroy the
manufacturer's serial number or any other distinguishing number or
identification mark.
8. "Gunsmith" means any person, firm, partnership, corporation or
company who engages in the business of repairing, altering, assembling,
manufacturing, cleaning, polishing, engraving or trueing, or who
performs any mechanical operation on, any firearm, large capacity
ammunition feeding device or machine-gun.

I'd have to check, I wonder if there is any relevant case law pertaining to this with regards to pistols and other "firearms".

Oh for sure. Hell why would they care, $30-$50 for a transfer that might sink the whole business? Can't say I'd do it either.

Buy any AR you want and do a fixed 10 shot magazine making it NYS compliant. Why the heck would you want to register your $1500+ rifle with these insane leftists?
