Spouse Mental Illness?

Have a good friend who owns a few guns and has a pistol permit. His wife has never been admitted into a hospital but was just recommended to see a psychiatrist for further assistance with her depression and anxiety due to limitations on what a regular doctor can prescribe for meds.

I tried to do some research on it for him, but I can’t come up with anything relating to his situation. Mainly just felony spousal stuff. Obviously his main concern is, is he gonna get a knock at his door and get his s*it taken because of his wife’s treatment? Thanks guys.

No, there is no law that allows one's guns to be taken if a loved one is mentally ill (afaik). There are some safe storage laws that mandate that the guns be kept away from these people (locked up) if not under the owner's immediate control.

Whether the law requires it or not, your friend should certainly see to it all guns are safely stored. If there is a concern of suicide then he should ensure his wife cannot get access to them. Sad to see this situation end in tragedy.

Just because someone has depression or anxiety doesn't mean they're suicidal, homicidal or going to inflict harm on themselves or others. Frankly, it's no ones business. No laws that I know of. Pistol Permit applications only ask for your (meaning applicant's) mental condition not anyone living in the home. FWIW, I would consider having the firearms safely stored if he's concerned that she might do something. Other than that, I don't consider it an issue.

He has a gun safe and everything is locked up so that’s not a concern as far as storage goes. With the gun laws getting tighter and tighter he’s just a good bit nervous.

I could see the red flag laws being used for this. If she says my husband has guns and I’m going to use them to kill so and so they are gone. Don’t forget a teacher can say this kids a danger and that kids parents guns are gone. Also in Vermont I think a relative I belive an uncle had his guns taken away because of something the nephew said at school.

If he is in nys the safe act manadayes the guns not be accessible by a felon or mentally ill person.

Yes I agree the red flag law should now be null and void for any relative but it won’t be. It will still be used. Remember they don’t want to keep people safe they want your guns.

In my county (Saratoga) they allow co-owning firearms, but I believe the co-owner must be the spouse. I never considered if it would apply to others. That's the whole reason I made (asked) her to get her permit!

The form with the arrow next to it (above) is to conduct Private Sales between “Immediate Family,” defined as Spouses, Domestic Partners, Children and Step-Children. If this exception (relationship) applies, you can complete the Executor Notarized Statement (Bill of Sale), to convey ownership to that individual. But of course I think this applies when you are: A. Dead B. No longer able to make your own decisions -or- C. acquire an arrest/conviction barring you from owning a Firearm...
It is similar to the Trust, in that it is a legal document to pre-sell your firearms (or give?) to that family member. I'm not sure which would prevail in the event of A, B, or C, or which would be the better choice.

While ideal to do that kind of thing now, I still have yet to do it. If using the co-own option, there would already be a "sale" so to speak that already has taken place and there would be no further actions required.

A lot of lawyer speak there... or Holiday Inn Express experiences anyway.

Everyone here is missing the much greater risk that something comes up in therapy with his wife's issues and next thing you know she's filing for divorce and slaps him with a baseless restraining order, claiming she's in fear of him and he's at fault for whatever her issues are. He's out on the street, can't own gun, can't go home or contact his wife before he knows what hit him. Doesn't matter if he never did anything wrong, damage is done.

Legally, he's only required to keep the guns secured from his wife (e.g. locked up and she has no key/combo) if she's been involuntarily committed to a hospital by a judge or adjudicated mentally defective or such (or is otherwise a prohibited person). Or the new safe storage laws once they're in effect if they had kids in the house.

But practically speaking if his wife has mental health issues that means he has issues. And he should be worried about their marriage and make sure he takes care of it and that whatever "help" she's getting is really helpful.
