How many studies and surveys have been done of oh hey do you own a stun gun or taser? Never been asked that question once.

Was this not settled at SCOTUS in the Caetano case? At least the possession and carry of. There was no ruling as to the hoops of regulation thereof. However with no legislation in NYS regarding such regulation you should be able to keep and bear them? IDoes this mean if SCOTUS nuts up and strikes down unconstitutional AW and Magazine bans that the lower courts can ignore the ruling? I fully expect that NYS would come up with some sort of massive regulatory scheme (already partially in place via SAFE) but, can the lower courts rule that these things are not in common use? SCOTUS really needs to put in their rulings that the states MUST adhere to the constitutionality of such rulings in both spirit and written law. Otherwise the Anti Gun States and activist lower judicial courts will continue to perform acrobatics to circumvent these rulings. Much like Kavanaghs' dicta that allowed for licensing schemes NY took full advantage of it with the already pre written CCIA. Talk about leaving a "loophole" in the ruling.

My daughters carry one in public and have since they lived in NY. Every cop of every agency I’ve ever seen or interacted with in NY has one. Many of my acquaintances have carried them as well. I had a nice Taser Strikelight on me doing grocery deliveries in Rochester/Buffalo/Syracuse… well, until it fell out of my pocket and I backed over it with a loaded tractor trailer!

They’re definitely in common use from my perspective.

When SCOTUS ruled they were legal, whoever wrote the decision said they are in common use. Had this dumb in NY ass read the decision... oh wait, they just don't give a fuck.

The only up side I suppose is that tasers are much pretty much trash as a self defense tool overall, often not doing what they're suposed to or having the intended effect, and stun guns have always been an absolute joke; basically a novelty item. Honestly, I believe stun guns put people in more danger, by giving them the idea that they have any even remotely effective form of self defense.

Anything that is "new" would never be able to reach the "in common use" level.

It wasn't and isn't necessarily only those Rights discussed to be acknowledged, not created or established by committees... Neither is "common use" a criteria by which establishes anything other than a common use. But shall a single person discover and deploy a methodology utilized in order to effectuate what "IS" recognized as a Right, I fail to see ANY encumbrances employed in its use as being anything other than a Restriction or Defacto Restriction of said Right(s).

Common Use is nothing more than a "Good Character" clause, or Safe Storage, or Need, etc... That these municipalities employ in order to Stop a Citizen from exercising a Right, here, one of the most fundamental, the Right to Defense (preserve life)... Can't understand how something so simple, can be so bastardized by the Left leaning liberal mindset! But this can be tracked back to the Hunters and Gatherers for sure...
