The concept is the simple part. Most cops will know the basic levels of a crime, then charge the specific sections when they are processing the arrest. The computer system actually walks you through choosing the correct subsections.
Besides assault and the larcenies, very few people I know can cite specific sections for each crime unless it’s their specialty like narcotics cops, homicide detectives, etc.
By “the concept” I am referring to how a weapon becomes a weapon. Either by law - in the case of a machine gun for example - or by its use. Literally anything can become a weapon if used to menace or assault.

I was told ,allthough it was over turned until the penal code is changed you most likely will be charged as a crime. lose your fire arms until you can get thru the system , You will win but you'll be in the court system for years and thousands of dollars

To me CPW is CPW but Criminal Use of a Firearm is Criminal Use of a Firearm. 265.20's exemption only applies to the former.
You’re going to have to take it up with a DA then I guess.
Btw, it sort of goes both ways. I know of two cases, one in Brooklyn and one in Newburgh, where an otherwise illegal firearm was used in justified self-defense and the person wasn’t charged with the gun crimes. Actually the recent burglary case as well, where the dude killed two people with his deceased father’s handgun.

In that case, they just failed to charge him. But how can you get charged with CPW when it specifically says that you are exempted from it via Penal Law 400? That’s the whole reason why CUF is in there.
