As shitty as it is for them to not hear these, it almost makes one wonder if they know they would have to rule in favor of the 2A and in doing so would just cause a cluster fuck thanks to states like CA NY NJ and so on.
So by not hearing the cases they are not necessarily agreeing with the lower court but more or less not wanting to pass down a pro 2A ruling

They have some more work to do. They need to clarify which weapons are protected as 'militia' weapons, and they need a ruling on defining 'bear' arms. Would I love to see them rule that unlicensed open and concealed carry is protected as 'bearing arms'.
Ummmmm they have done the first part. Commonly owned weapons are protected. Ones already defined by the NFA are not hence why they can stay on the NFA

Yeh the US vs Miller NFA ruling is more of a ruling on what a militia arm isn't, rather than what it is. I'll have to reread the more recent rulings re: protected militia arms. I'm getting older and memory not what it used to be.

Perhaps they are holding out for a bigger case that they expect come down the pipeline. At least that's something we can hope for. If they keep denying critical Second Amendment cases then we need to start pushing for impeachment.

I seriously do not have much trust in Roberts or Kennedy. Everytown is confident Kennedy feels the country is driving too far to the right and Roberts already proved he would pimp out on his integrity by not following the Constitution / written laws in an attempt to keep the progressive left peaceful.

Kennedy is a mystery to me and hard to predict, he seems to be one whose main principle is to have no principles. Roberts is easy, a man of constitutional instinct, but has been compromised and blackmailed by the fact that he illegally adopted at least one child. Does his weird decision on obama care, which is second only to the idiot judge in Buffalo citing mother earth news as the most outlandish misconstruction of the constitution since the supremes actually decided to entertain Roe V. Wade.

This is the most infuriating aspect of this whole thing. We should have had our rights back 2 years ago. Heller is pretty damn clear and lower courts have literally been making up new ways to rubber stamp all of these unconstitutional laws.

Don't these a-holes talk to each other? Why else would Thomas be so pissed off? Like I said, I don't even care anymore if the rest of the country falls. We lost our rights and they're gone. If the rest of the country has to suffer for a chance at everyone getting their rights back, so be it.

What case would that be? Kolbe was pretty f'ing big. That decision was RIPE for reversal. They could have clarified strict scrutiny.

Staying positive is hard, especially in NY. All I see is corruption from the Supreme Court to the NYS Legislature.
At this point, unless the SC steps in, the rest of the country WILL fall. It is only a matter of time. It just feels like we are never going to get our rights back. The longer this law is in place the more "normal" it will become.
