Not sure how they came up with that charge, PA is an open carry state a license to carry is only needed for concealed carry as far as I know. Unless it's a local law but that should be superseded by state law ??

The details I've heard on this one is that he was at a rental property he owned that was vacant and not his primary residence. So PA decided he was carrying concealed without a license. Bunch of bullshit for a DA trying to jam up a law abiding citizen for defending himself, while others are turning dangerous career criminals loose with appearance tickets.

I keep saying it. The police are the problem. They take an oath to uphold the Constitution and cases like this one prove otherwise. Face it, the Constitution means nothing if those who are suppose to uphold and enforce the law simply decide not to. And why should they? Who's going to hold them accoutable?

Interestingly, whether or not he owned or resided in the property isn't actually the issue... it's most likely how he got the gun there that they're using to charge him. As others have pointed out, he doesn't need a license to own a pistol and he doesn't need an LTCF to openly carry. But, there are some nitty-gritty rules that may be involved here:

1. If PA is in a state of emergency, one needs an LTCF to carry openly. I am not certain, but I believe PA has been in a perpetual state of emergency since 2020 due to COVID.
2. Even if outside a state of emergency, PA residents cannot transport their pistol in a vehicle, get out, and start openly carrying it unless they have an LTCF (oddly enough, non-residents of PA can do this so long as they possess a permit from their state of residence).

So, my guess is that either the SoE is still in effect, or he drove to the property, and someone decided to screw him over. Note that I am just guessing.

They take an Oath to uphold the Constitution of the United States, everyone that works for Government does and yet those that represent us (ok, themselves and the special interests that bribe them) and yet there is never any ramifications for passing Laws in conflict and opposition to the Constitution...The Cops are hired to enforce and uphold the Laws written by Legislators and passed accordingly. People are constantly bitching about the Judges not doing their jobs by setting persons arrested for crimes free without Bail, yet FAIL to realize or accept that the Judge did not write the Laws, their punishments, and applications it was the jackasses in the Legislature (inclusive of Congress and the bureaucracies afforded abilities to write violations as Laws without oversight see the Chevron Defense but I digress.

I recall something of the sort, so you are probably right. But a quick search didn't pull up much, and I also couldn't figure out whether or not there was still an active SoE or not, so I listed it as a possibility.

Hard to find definitive info, particularly in a quick search, and I suspect that is very intentional. Seems like PA is going the way of NY, where the government works against the people instead of for the people.

PA open carry is dicey without an LTCF. Reason being, if the corner of your shirt draped over the handle of your otherwise openly carried handgun, you could be then charged with concealing without a license. Ergo, get the damn LTCF, it’s $20 and 20 minutes of your time.
