To My Surprise Many States Recognize NY Pistol License

I was just on the NRA website checking something about NY State firearms laws. As I scrolled down the page at this link, I was surprised to discover that 23 states (if I counted correctly) recognize NY State pistol licenses. That stands despite the fact that NYS does not reciprocate for even a single other state.

Of course, neither that fact nor the fact that I am a retired LEO qualified under LEOSA allow me to carry within a Gun-Free School Zone, outside of NY or PA, if I know or have reasonable cause to believe I am in a GFSZ. FU-GHWB, for signing this into law, you make believe conservative!

Crap like we have in NY is what has had me attend a few pro-gun rallies in NY and also has had me sending letters and emails to elected officials for years longer ago that the first pro-gun rally I attended. That I was in LE for 32 years never meant to me that I had more of a right to carry than anyone else; so, I joined the NRA, the NYSRPA, and donate to those two and a few others like the SAF, NAGR and so on. I have little respect if any for petty tyrants like Cuomo or Bloomberg and do what I can to try to change the laws to actually recognize our RKBA and to allow us our liberty to exercise that right. But yes, it sure is nice to enjoy the freedom in other parts of America. Have been to a few private group shoots in NH with my son, he shot pistols at the shoots and at ranges in NH. Have been to likewise in WV with him. Also have shot pistols with him at a range in PA. We also shot full auto firearms in a few places. In AK, he legally carried the entire time we were there. All hot diggity shooty goodness that is completely legal outside of NYS but not within if you do not have a license and my son did not have a NYS pistol license nor a license anywhere else I just mentioned.

I spend a lot of time in NH; My other half is a retired LEO out there. I also have spent a lot of time in Pennsylvania in the last year.

It was amazing what you could see on the shelves in not just a gun shop, but even a plain-jane sporting goods store. Hell, bricks of .22lr are still sold over the counter in the hardware stores in rural New Hampshire!

I walked into a sporting goods store in Erie, PA and picked up a box of .45 for a handgun that I had ordered but had not yet added to my NY license. As I walked around the store with it, I actually felt like I had a guilty conscience or that I was somehow breaking the law. The reality is that they couldn't give two shits, as long as I was over 18.

It was then that I realized exactly how conditioned so many of us here in New York have become. It's disgusting to see how much we've been willing to give up here. And it was then that I made the decision - I will give them no more.

Not good, an expectation you can only buy ammo for guns on your permit. You must of been trained this is true by visiting stores that require you show your license for pistol ammunition. Does some one have the right to collect pistol ammo and buy any box they want and at any store?

I was amazed when we were traveling down here to Kentucky before our move. I called the local Sheriff's office here and asked about carrying here. I was told that KY recognizes ALL state's permit. I then said, mine is a "Full Carry" permit, and he replied: "If it says Full Carry, the By God you can Full Carry down here with it".
When we decided we were going to make the move down here I stopped by the local Sheriff's office to find out what I had to do to bring my firearms down here and was told: "just bring 'em with ya'! I was told that this is "Free America" and they don't register ANY guns to you.

I did get my CCDW license down here which so I can CC (otherwise it is OC), which allows me to CC in pretty much all the "REAL" states in "Free America"!.

No permit is required to buy ammo in NY.



As far as other States recognizing NY permits, yeah, pretty awesome. It really is kind of funny, most residents in other States never talk about these things like we do. Freedom is a wonderful thing.

The Gun-Free School Zones Act (GFSZA) is an act of the U.S. Congress signed into law by President George H.W. Bush that prohibits any unauthorized individual from knowingly possessing a firearm at a place that the individual knows, or has reasonable cause to believe, is a school zone as defined by 18 U.S.C. § 921(a)(25)


Is there a definition of of unauthorized/authorized individual in regards to this that you know of?

I do not know that the actual statute says anything about "any unauthorized individual"; however, if it does mention that particular phrase then I would imagine it to mean anyone who does not fit into one of the exceptions but that is just my guess. The exceptions to the law are supposedly as follow:

Exceptions[edit]
Pursuant to 18 U.S.C. § 922(q)(2)(B):

[18 U.S.C. § 922(q)(2)(A)] does not apply to the possession of a firearm—

(i) on private property not part of school grounds;

(ii) if the individual possessing the firearm is licensed to do so by the State in which the school zone is located or a political subdivision of the State, and the law of the State or political subdivision requires that, before an individual obtains such a license, the law enforcement authorities of the State or political subdivision verify that the individual is qualified under law to receive the license;

(iii) that is—

(I) not loaded; and

(II) in a locked container, or a locked firearms rack that is on a motor vehicle;

(iv) by an individual for use in a program approved by a school in the school zone;

(v) by an individual in accordance with a contract entered into between a school in the school zone and the individual or an employer of the individual;

(vi) by a law enforcement officer acting in his or her official capacity; or

(vii) that is unloaded and is possessed by an individual while traversing school premises for the purpose of gaining access to public or private lands open to hunting, if the entry on school premises is authorized by school authorities.

Based upon training I have received, many LEOs wrongly believe they are protected (or exempt) from this law if they are LEOSA certified/qualified. That course was given by a federal magistrate judge through Sheepdog Academy, who stated that LEOSA does not exempt a LEO or a retired LEO from this ridiculous law; so if carrying under LEOSA alone, and the state in which carrying requires a carry license, the LEO or retired LEO carrying under authority of LEOSA would be in deep doo-doo if within a GFSZ. As per that same class, federal prosecutions of LEOs reportedly have taken place under this law for just that.

Consider just how ridiculous the Gun-Free School Zone law is by merely considering one aspect of it. The person carrying a firearm must know or have reasonable cause to believe he is in a school zone in order to violate this law. So, let's say we have a gun owner, traveling through state X while carrying. He is legally carrying while not in a school zone because he is licensed in state Y and state X recognizes a license from state Y as valid in state X. As he is driving along, he sees a sign just ahead stating that there is a reduced speed ahead because he is about to pass through a school zone. He had not known this until he saw the sign but he knows it now. As per the law the way it was written, he could not be prosecuted unless he knew or had reasonable cause to believe he was in a school zone. He did not know it, nor did he have reasonable cause to believe it, until he saw that sign. By the time he has seen the sign though, he is within a couple hundred feet of an elementary school. That means he is also with 1,000 feet of a school and thus is in a gun-free school zone as per the federal law and it also means he knows he is in one. If he continues on his way - he is in violation of the law. If he tries to turn around and go back the other way - he is still in violation of the law because he is within 1,000 feet of the school and thus in the gun free zone. If he stops, takes off his gun and locks it in a case - he would still be in violation because he is there and he knows it and the law does not make an exception for someone who suddenly finds himself in that pickle. In my estimation, the law, by virtue of how it was crafted by arsehats, has now made him a criminal by way of entrapment because it makes no provision for people finding themselves in that very plausible situation to correct it. You can safely bet that somewhere at some time that will happen and some hardnosed LEO will arrest the guy and an arsehat prosecutor will take it to trial or the guy may just plead guilty. It is, in my opinion, one heck of a lousy piece of legislation.

I'm not surprised that most states honor NY permits. Most states respect their residents and the Constitution.
It's only here and in CA, MA, CT that the govn't treat their citizens like Pion-Peasants
