Palm Beach County State Attorney Says Jack Smith Close to Using ‘Nuclear Button’ to Remove Judge Cannon From Trump Classified Docs Case Over Her Jury Instruction Order​

“He is close to pushing the nuclear button,” said Palm Beach County State Attorney David Aronberg, according to NBC News. “It is a high burden to reach, and it is rarely done, but her proposed jury instructions may have pushed him to the breaking point.”

Last month Judge Aileen Cannon issued a jury instruction order in Jack Smith’s classified documents case and the leftist legal analysts went apocalyptic.
The first option:

In a prosecution of a former president for allegedly retaining documents in violation of 18 U.S.C. § 793(e), a jury is permitted to examine a record retained by a former president in his/her personal possession at the end of his/her presidency and make a factual finding as to whether the government has proven beyond a reasonable doubt that it is personal or presidential using the definitions set forth in the Presidential Records Act (PRA).

The second option is:

A president has sole authority under the PRA to categorize records as personal or presidential during his/her presidency. Neither a court nor a jury is permitted to make or review such a categorization decision. Although there is no formal means in the PRA by which a president is to make that categorization, an outgoing president’s decision to exclude what he/she considers to be personal records from presidential records transmitted to the National Archives and Records Administration constitutes a president’s categorization of those records as personal under the PRA.

Jack Smith earlier this week threatened to take the jury instruction fight to the appellate court.

Judge Cannon Unseals and Un-redacts Trump Legal Motion that Exposes DOJ Fraudulent Case Against Him​

One of the ways this Lawfare approach was identifiable, was in the specific parseltongue way the wording of the legal filings were pushed. Example: they didn’t say Trump held classified documents; they said Trump held documents containing “classified markings.” Declassified documents still hold classified markings. There’s a big difference between “classified documents” and “documents containing classified markings.” The intent of using the linguistics of the latter is to give the impression of something nefarious where nothing nefarious exists.

The special counsel then used the auspices of national security, to control -through redactions and secrecy- the types of information within their court filings that would be visible to the public. Remember, this is LAWFARE and the primary interest of Lawfare is to influence public opinion.

We also noted, at the time, that Judge Aileen Cannon very obviously knew what the Special Counsel was attempting to do. The judge could see how the DOJ was weaponizing the national security angle as a way to target the defendant, Trump, in a way that he would not be able to defend himself. Cannon saw this and began structuring her rulings to combat the secrecy with sunlight.

In this latest decision by Judge Cannon, she has exposed the motives and intentions of the special counsel by un-redacting the 68-page defense motion that Jack Smith previously redacted.

This redacted -vs- unredacted approach allows a comparison between the information provided by the Trump defense team, and the information the Jack Smith team does not want the public to know. [example]

Unredacted motion reveals collaboration between Biden White House and NARA to concoct classified docs case against Trump​

The Monday filing includes sections of the original January document that had initially been heavily redacted.
On Monday, a version of Donald Trump’s motion to compel discovery in the Mar-a-Lago documents case was released by Judge Aileen Cannon with much of the information originally redacted by Biden’s special counsel Jack Smith being unredacted.
In one section titled "Early Indications of NARA Bias," which was heavily redacted in its original, January 16 version, it now states that NARA General Counsel Gary Stern sent an internal email attaching a draft letter to President Trump’s [Presidential Records Act] representatives. Stern noted that he 'had several conversations' with [White House Office of Records Management]'s [redacted] and that [redacted] had 'raised some of these concerns directly with David [Ferriero, NARA’s Archivist]."
